122 <br /> <br />Section 3-2 ($50/day); <br /> <br />Vendor regulations in accordance with City Code <br />Section 28-111, et seq., provided, however, that. <br />vendors shall be'allowed to operate until 11:00 <br />p.m. for the duration.of the festival; <br /> <br />Liability insurance in the amount of at least <br />$1,000,000 with certificate of insurance naming <br />City as an additional insured; <br /> <br />Permit for fireworks display approved by Fire <br />Department; <br /> <br /> 6. Inspection of amusement rides. <br />~STAFF REPORT: CABLE TELEVISION <br /> <br /> Mr. Clyde Gouldman, City Attorney, explained .that under <br />current federal law Council cannot regulate cable rates but <br />has some control over picture quality, customer service and <br />complaints and provision of one or more channels ~for public <br />education. Mr. Gouldman requested that Council authorize <br />staff to secure a firm which has engineering, financial and <br />legal expertise in cable franchise negotiations, adding that <br />fees are almost always picked up by the cable company as part <br />of the renewal cost. Mr. Gouldman continued that the law <br />states that the City must first negotiate with the existing <br />cable company. Mr. Gouldman noted that the current franchise <br />is non-exclusive, but he would like to further research what <br />this means. <br /> <br /> Mr. Vandever questioned whether a second franchise would <br />need to be granted should another company wish to provide <br />cable service in the area and Mr. Gouldman replied that he <br />thought a second franchise would be required. <br /> <br /> Mr. Toscano made a motion to authorize the hiring of a <br />cable expert, adding that he felt Adelphia Cable should <br />roll back the recently imposed $50 "installation" fee as an <br />act of good faith. Mr. Toscano stated that he would be <br />interested in finding out how much it would cost for the City <br />to take over cable operations. <br /> <br /> Ms. Waters seconded the motion and stated that a second <br />option for the cable company would be to allow customers to <br />pay the $50 over a period of time. <br /> <br /> councilors requested that staff.officially contact <br />Adelphia Cable regarding the City's and customers' concerns <br />and also notify other potential cable operators of the <br />upcoming franchise renewal and process. <br /> <br /> Council unanimously voted to authorize staff to hire a <br />cable expert to advise the City regarding~franchise <br />negotiations. <br /> <br />APPROPRIATION: <br /> <br />CDBG REPROGRAMMING (2nd reading) <br /> <br /> The appropriation reprogramming Community Development <br />Block Grant funds which was offered at the January 7th <br />meeting was approved by the following vote. Ayes: Rev. <br />Edwards, Ms. Slaughter, Mr. Toscano, Mr. Vandever, Ms. <br />Waters. <br /> <br /> WHEREAS, the Council has previously approved the <br />appropriation of certain sums of the City's Capital <br />Improvement Program (CIP) and federal grant receipts to <br />specified accounts in the City's CIP Fund and Community <br />Development Block Grant (CDBG) Fund respectively; and <br /> <br />WHEREAS, it now appears that portions of the amounts <br /> <br /> <br />
