On motion by Mr. Toscano, seconded by Ms. Slaughter, the ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTIONS 31-186 THROUGH 31-226, AND ADD NEW SECTIONS NUMBERED 31-227 AND 31-228, OF THE CODE OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, 1990, AS AMENDED, RELATING TO THE SEWERAGE USER REGULATIONS OF THE RIVANNA WATER AND SEWER AUTHORITY" was offered and carried over to the next meeting for consideration. ~ PUBLIC There were no matters by the public. OTHER BUSINESS .Rev. Edwards stated that he had been struggling with the issue of notifying affected homeowners of the propoSed zoning changes and was considering reversing his previous vote on the matter. Mr. Vandever stated that he continued to have concerns about sending out individual notices, adding that the matter has been under discussion for two years and he felt the pressure on Council to send notices was a predictable tactical defense from people who oppose the changes. Ms. Slaughter stated that she felt sending notices Would provide CounCil with different points of view. Mr. Vandever stated that he felt it~ could be argued that areas not in the proposed areas could also be impacted by the changes. Mr. Satyendra Huja, Director of Community Development, noted that proposed text changes in the ordinance will impact people who cannot be identified and recommended that if notices are sent that they be sent to all property owners in the City. Mr. Gouldman recommended that if notices are sent to persons potentially affected by the doWnzoning proposal, then notices should be sent to those properties in the proposed overlay zones. Rev. Edwards stated that his previous vote against sending notices would stand. On motion by Mr. Toscano, seconded by Ms. Slaughter, Council voted to meet in executive session to discuss a personnel matter as exempted by Section 2.1-344(a)(1) of the Virginia Freedom of Information Act. Council reconvened in open session and, on motion by Mr. Toscano, seconded by Mr. Vandever, unanimously certified, with Ms. Waters absent, that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to. which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Council. rned Presidents
