This permit may be revoked by City Council at any <br />time after a hearing conducted at any regular meeting, <br />provided the operator has been notified of the hearing by <br />written notice delivered to its place of business at least <br />ten days before such meeting, if theiCouncillfinds: (a) that <br />the operator is violating the terms of the permit; (b) is <br />delinquent ~in paying rent which may subsequently be imposed <br />hereunder) (c) that the continued operation of the cafe poses <br />a threat to the public health, safety or. welfare or. <br />constitutes a public nuisance; or (d) if by June 1st in any. <br />calendar year cOvered by this permit, the outdoor cafe has <br />not been in substantial operation for a period of 60 days, or <br />if the cafe ceases operation for a period of 30 days or more <br />prior to Labor Day of any year. <br /> <br /> 9. This permit may be revoked at any time upon six <br />months' notice to the operator, for any public purpose as <br />determined~by the City Council. <br /> <br /> 10. Approval of this permit is conditioned upon the <br />applicant's continued compliance with the plans previously <br />approved by the Downtown Board of Architectural Review. <br /> <br />RESOLUTIONS: APPROVING TRANSPORTATION FUND GRANT APPLICATIONS <br /> <br /> Mr. Hendrix explained that the two resolutions would <br />authorize the submission of grant applications for capital <br />items and operating items. <br /> <br /> On motion by Ms. Slaughter, seconded by Ms. Waters, the <br />resolution approving a grant application for transportation <br />capital items was approved by Council, with Rev. Edwards <br />absent for the vote. ~ . <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF CHARLOTTESVILLE <br />that the City Manager is authorized, for and on behalf of the <br />City of Charlottesville, hereafter referred to as The Public <br />Body, to execute and file an application to the Virginia <br />Department of Transportation, Commonwealth of Virginia, <br />hereafter referred to as The Department, for a grant of <br />public ~transportation financial assistance for capital <br />expenses in the amount of $11,091.25 to defray ninety-five <br />percent (95%) of the costs borne by The Public Body for <br />equipment, facilities, and the associated expenses of an <br />approved Federal Capital Grant, to accept from The Department <br />grants in such amounts as may be awarded, and to authorize <br />The Transit Manager to furnish to The Department such <br />documents as may be required for processing the grant <br />request. <br /> <br /> The City Council of Charlottesville certifies that the <br />funds shall be used in accordance with the requirements of <br />Section 58.1-2425.E.3 of the Code of Virginia, that The <br />Public Body will provide matching funds in the ratio as <br />required in such Act, that the records of receipts of <br />expenditures of funds granted The Public Body may be subject <br />to audit by The Department and by the State Auditor of Public <br />Accounts, and that funds granted to The Public Body for <br />defraying the public transportation capital expenses of The <br />Public Body shall be used only for such purposes as <br />authorized in the Code of Virginia. <br /> <br /> On motion by Ms. Slaughter, seconded by Ms. Waters, the <br />resolution approving a grant application for transportation <br />operating items was approved by Council, with Rev.
