213 <br /> <br />Body, to execute and file.an application to the Virginia <br />Department of Transportation, Commonwealth of Virginia, <br />hereafter referred to as The Department, for a grant of <br />public transportation financial assistance for the fiscal <br />year commencing July 1, 1991 in the amount of $460,322.97 to <br />defray the public transportation administrative and fuels, <br />lubricants, tires and maintenance parts and supplies costs <br />borne by The Public Body and to accept from The Department <br />grants in such amounts as may be awarded, and to authorize <br />The Transit Manager to furnish to The'Department such <br />documents as may be required for processing the grant <br />request. <br /> <br /> The City Council of Charlottesville certifies that the <br />funds shall be used in accordance with the requirements of <br />Section 58.1-2425.E.3 of-the Code of Virginia, that The <br />Public Body will provide matching funds in the ratio as <br />required in such Act, that the records of receipts of <br />expenditures of funds granted The Public Body may be subject <br />to audit by The Department and by the State Auditor of Public <br />Accounts, and that funds granted to The Public Body shall be <br />used only for such purposes as authorized in the Code of <br />Virginia. <br /> <br />ORDINANCE: CITY MARKET REGULATIONS (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND <br /> REORDAIN SECTION 8-4 OF THE CODE OF THE CITM OF~¥~. ~ <br /> CHARLOTTESVILLE, 1990, AS AMENDED, RELATING TO THE'~CITY <br /> MARKET RULES AND REGULATIONS,,, which was offered at the April <br /> !5th meeting, was approved-by the following vote. Ayes: Ms. <br /> Slaughter, Mr. Toscano, Mr. Vandever, Ms. Waters. Noes: <br /> None. Absent: Rev. Edwards. <br /> <br />ORDINANCE: REZONING 324 llTH STREET, 'N.E. FROM R-2 TO B-1 ' <br /> <br /> Mr. Huja stated that the Planning Commission recommended <br /> denial of the rezoning for the following reasons: 1) It is <br /> contrary to the Land Use Plan of the Comprehensive Plan; 2) <br /> The site is not sufficient in size to permit the use of the <br /> entire building for office use and get adequate parking; and <br /> 3) The uses surrounding the property are currently <br /> residential and an office use would not be compatible with <br /> these uses. <br /> <br /> Ms. Slaughter made a motion to deny- the rezoning of 324 <br /> llth Street, N.E. for the reasons given by the Planning <br /> Commission above. Ms. Waters seconded the motion and the <br /> rezoning was denied, with Rev. Edwards :absent for the ~vote. <br /> <br />ORDINANCE: EARLY RETIREMENT OPTIONS <br /> <br /> Mr. Hendrix explained that early retirement options had <br /> been developed as a downsizing tool with the following <br /> provisions:, for those employees age 52 with 30 years of <br /> service (age 52 and five years of service for public safety <br /> employees), age 55 with 27 years of service or age 57 with <br /> five years of service, add either three years to age or <br /> service; final average compensation to be based on the last <br /> twelve months of service; a supplement will be added until <br /> the employee reaches age 62, The period employees will be <br /> given to elect to retire will run from June 1 until September <br /> 30th, but will include employees who meet the requirements as <br /> of June 30, 1992, with retirement required the month after <br /> the decision is made, or the first month of eligibility, <br /> except that the City Manager can choose to retain an employee <br /> beyond that date. Mr. Hendrix stated that the actuaries have <br /> studied the issue and reported that the proposal will not add <br /> to the cost of the plan as long as the positions are not <br /> refilled. Mr. Hendrix stated that the Retirement Commission <br /> recommended that the early retirement plan be approved. Mr. <br /> Hendrix recommended that the ordinance be amended to add a <br /> <br /> <br />
