245 <br /> <br />Charlottesville, in full compliance with all of the terms and <br />conditions of the Franchise for a period commencing on the <br />expiration date of the Franchise and continuing through <br />either the date on which the Franchise is renewed, or May 1, <br />1992, whichever shall first occur; <br /> <br /> 2. During said period, the City and Adelphia shall have <br />all of the rights and obligations of "City" and "Company<" <br />respectively, under the Franchise; <br /> <br /> 3. During said period, the City and AdelPhia shall work <br />together in good faith to negotiate a renewal of the <br />Franchise; <br /> <br /> 4. This Resolution shall become effective upon the <br />occurrence of both of the following conditions: (1) The <br />Resolution being passed and adopted by the City Council; and <br />2) Adelphia's acceptance of the Franchise for the term <br />specified in paragraph (a) above, provided Adelphia accepts <br />the Franchise within seven (7) days from the date this <br />Resolution is passed and adopted. <br /> <br /> Mr. Gouldman noted that federal law requires the City to <br />negotiate in good faith with the current Cable provider. <br /> <br />ORDINANCE: ADOPTING UTILITY RATES AND FEES (2nd reading) <br /> <br /> Mr. Hendrix stated that staff recommended that the <br /> reconnection fee be $10 for those customers in good <br /> standing who use gas only for heating and who wish to <br /> disconnect their service during warm weather months. <br /> <br /> Ms. Slaughter stated that she was pleased with the <br />solution and made a motion to amend the ordinance as written. <br />Ms. Waters seconded the motion to amend. <br /> <br /> Rev. Edwards questioned how much the redUction in the <br />reconnection fee would cost in the long run and indicated he <br />would like to revisit the matter next year. <br /> <br /> Ms. Rita Scott, Director of Finance, stated that it was <br />estimated that approximately 500 customers use gas for <br />heating only and that the cost to the City to discOnnect and <br />reconnect is probably $20. Ms. Scott agreed that the fee <br />should be kept at $10 and that the fee and cost to the citY <br />should be eValuated next year. <br /> <br /> The amendment reducing the reconnect fee to $10 was <br />unanimously approved. <br /> <br /> The ordinances entitled "AN ORDINANCE AMENDING AND <br />REORDAINING SECTIONS 31-29, 31-56, 31-57, 31-59, 31-60, <br />31-61, 31-62, 31-64, 31-66, 31-104, 31-152, 31-153, 31-156 <br />AND 31-159 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, RELATING TO UTILITY RATES, DEPOSITS AND FEES," as <br />amended, and 'tAN ORDINANCE AMENDING AND REORDAINING SECTION <br />11-95 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS <br />AMENDED, RELATING TO THE COLLECTION OF GAS AND WATER CHARGES <br />BY THE DIRECTOR OF FINANCE," which were offered at the June <br />3rd meeting, were approved by the following vote. Ayes: <br />Rev. Edwards, Ms. Slaughter, Mr. Toscano, Ms. Waters. Noes: <br />None. Absent: Mr. Vandever. <br /> <br />ORDINANCE: AMENDING ANNUAL BUDGET - UTILITY FUND <br /> <br /> Mr. Hendrix explained that the rates had not been set <br />when the budget was adopted and therefore the budget needed <br />to be amended to include the Utility budget. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Waters, the <br />ordinance to amend the Annual Budget to include the Utility <br />Fund was offered and carried over to the next meeting for <br />consideration. <br /> <br /> <br />
