244 <br /> <br />increase in service capacity from 47 youth slots to 50 youth <br />slots while decreasing costs by $194,248 in Fiscal Year 1992 <br />compared with Fiscal Year 1991; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the Council of the <br />City of Charlottesville supports the proposed restructuring <br />of the Community Attention programs which will consolidate <br />its existing two group homes into one, and expand the Family <br />Group Homes and Community Supervision services; and, <br /> <br /> BE IT FURTHER RESOLVED, that the Department of Youth and <br />Family Services and the Commonwealth of Virginia are <br />requested to give sufficient resources to local programs to <br />support the community based services which will be needed to <br />reduce the number of youth served in state programs and <br />facilities. <br /> <br />RESOLUTION: TEMPORARY EXTENSION OF CABLE FRANCHISE <br /> <br /> Mr. Gouldman stated that the resolution would extend the <br />current franchise with Adelphia Cable until May 1, 1992, or <br />until the date of renewal, noting that the extension does not <br />guarantee that the franchise will be renewed. Ms. Gouldman <br />stated that the Cable Committee recommended that Council <br />approve the resolution. <br /> <br /> Ms. Waters stated that she understand that federal laws <br />appear to be changing which may allow the City to regulate <br />some rates. <br /> <br /> Mr. Gouldman stated that "effective competition" is in <br />the process of being defined, and that if it is found that <br />there is no effective competition in Charlottesville then <br />only the lowest, basic service could be regulated by the <br />City. <br /> <br /> On motion by Ms. Slaughter, seconded by Mr. Toscano, the <br />resolution granting a temporary extension of the cable <br />franchise was unanimously approved. <br /> <br /> WHEREAS, on or about July 1, 1986, the City of <br />Charlottesville, Virginia (the "City") awarded a Cable <br />Television Franchise to Adelphia Communications Corporation <br />("Adelphia") (hereinafter referred to as the "Franchise"), <br />for a term of five (5) years; and <br /> <br /> WHEREAS, the City has received timely notice from <br />Adelphia of its intent to renew the Franchise; and <br /> <br /> WHEREAS, the City acknowledges that Adelphia will not, <br />by virtue of accepting an extension of the Franchise term, <br />waive any of 'its renewal rights under Section 626(a) through <br />Section 626(g) and Section 635 of the Cable Communications <br />Policy Act of 1984 ("Cable Act"); and <br /> <br /> WHEREAS, ithe City will provide Adelphia all of the <br />substantive and procedural protections due it under the Cable <br />Act; and <br /> <br /> WHEREAS, the Franchise expires on or about July 1, 1991, <br />leaving both Adelphia and the City without an effective Cable <br />Communications Franchise unless the Franchise is extended; <br />and <br /> <br /> WHEREAS, the City and Adelphia desire to extend the term <br />of the Franchise to allow time to complete a Franchise <br />renewal process; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Charlottesville that: <br /> <br /> 1. The City hereby authorizes Adelphia Communications <br />Corporation to operate the cable television system in <br /> <br /> <br />
