262 <br /> <br />University of Virginia Hospital officials to exercise its <br />power of eminent domain to acquire properties in the location <br />proposed for Lane Road. <br /> <br /> Responding to a question from Ms. Slaughter, Mr. George <br />Gilliam, representing the UniverSity of Virginia Hospital, <br />stated that the University has limited right of' eminent <br />domain and the University has~been negotiating with the <br />property owner for two years andthe road relocation project <br />will be delayed if the City does not'~intervene, Mr. Gilliam <br />explained that the City can use a quick take procedure for <br />street use. <br /> <br /> Mrs. Toscano noted that theeminent domain proceedings <br />will not cost~ the City anything and~the owner will. be paid <br />for the property. <br /> <br /> Mr. Vandever stated that he felt there was a public <br />benefit in authorizing the eminent domain proceedings in that <br />it will provide safer, more efficient access to the hospital, <br />Mr. Vandever noted that the City is also assisting the <br />University asa good neighbor. <br /> <br /> On motion by MS, Waters, seconded'by Mr. Toscano, the <br />resolution authorizing eminent domain proceedings was ~ <br />unanimously approved by Council. <br /> <br /> WHEREAS,~ the University~of Virginia, in order to. <br />accommodate a proposed addition to Jordan Hall (the medical <br />school building) to provide enhanced medical~research ~ ~ <br />facilities, needs to close and relocate, a portion of Lane <br />Road in the City of Charlottesville; and <br /> <br /> WHEREAS, the relocation of Lane Road will necessitate <br />the closing of a portion of the existing Lane Road and <br />acquisition by the City of Charlottesville of two improved <br />properties that are located along the path of the proposed <br />realignment of Lane Road, as depicted on the attached plat; <br />and <br /> <br /> WHEREAS, in connection with said project, the City of <br />Charlottesville must approve the closure of the described <br />portion of Lane Road and obtain fee simple title to property <br />identified as Parcels 134 and 135, City Real Property Tax Map <br />11, which contains approximately 23,925 square feet, for use <br />as a street, with water, sewer or utility pipes or lines or <br />related facilities appurtenant to said street and transfer <br />said property to the University of Virginia before the <br />University of Virginia may proceed with the project; and <br /> <br /> WHEREAS, bona fide efforts have been made to acquire the <br />property by purchase f~om the owner, but the efforts have <br />been ineffectual because of the inability to agree on the <br />price or terms of sale of the property~ and <br /> <br /> WHEREAS, the City has no recourse but to acquire the <br />property through the exercise of its power of eminent domain <br />as authorized by the Code of Virginia and the Charter of the <br />City of Charlottesville; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED.by the Council of the <br />City of Charlottesville, Virginia, that the Mayor and Council <br />support and endorse the University project and concur that <br />the relocation of Lane Road and acquisition of the privately <br />owned properties satisfy a public purpose and necessity; and <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City of <br />Charlottesville, Virginia that such a public necessity is <br />hereby declared to exist for the acquisition of fee simple <br />title to Parcels 134 and 135, City Real Property Tax Map 11, <br />as more particularly described on the attached plat, in order <br />to fulfill the public purpose of constructing and providing <br />streets and sidewalks for vehicular and pedestrian traffic~ <br /> <br /> <br />
