i <br />• AN ORDINANCE TO AMEND THE ZONING MAP INCORPORATED <br />BY REFERENCE IN SECTION 4 OF THE ZONING ORDINANCE <br />OF THE CITY OF CHARLOTTESVILLE, <br />BY CHANGING TO PLANNED UNIT DEVELOPMENT ZONING CLASSIFICATION <br />TAX MAP PARCELS 25A-44, 25A-40 (Parts - Lots 6A and 5A), <br />25A LOTS 5B AND 6B, 21B-11 AND 218-12, <br />COMMONLY KNOWN AS THE WILLOUGHBY PROPERTY. <br />BE IT ORDAINED by the Council of the City of Charlottesville: <br />Section 1. That the zoning map, incorporated by reference in <br />Section 4 of the Zoning Ordinance of the City of Charlottesville <br />effective January 1, 1976, be amended by designating as Planned <br />Unit Development zoning classification those lots or parcels or <br />portions thereof designated as City Tax Map Parcels 25A-44, <br />25A-40 (Parts, Lots 6A and 5A), 25A -Lots 5B and 6B, 21B-11 and <br />21B-12 presently standing in the name of the Willoughby <br />Corporation and being a portion of that property commonly <br />referred to as Willoughby. <br />Section 2. That such approval is conditioned upon the following: <br />• (a) That development of the property be carried out in <br />conformity with the plans for development and related charts <br />submitted as a part of the application, which shall be kept on <br />file in the Department of Community Development. <br />(b) That the developer, upon commencement of development <br />of the property, proceed with the installation of a bicycle <br />trail as shown on such plans to create a loop trail along <br />Moore's Creek with connections to Fifth Street, S. W. <br />(c) That the overall density of development not exceed <br />6.3 dwelling units per acre or a total of 176 dwelling units. <br />(d) That the appropriate documents for formation or <br />incorporation of the residents' association for ownership <br />and maintenance of common spaces and facilities be submitted for <br />review and approval by the City Attorney prior to construction. <br />(e) That the plans be amended to show inclusion of a <br />children's play area in the city portion of the development. <br />(f) That development and construction on the property be <br />subject to all other requirements as set forth in the city code, <br />• zoning and subdivision ordinances and applicable state and federal <br />statutes, codes and regulations. <br />
