3. ordinance and the Code hereby adopted are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance or the Code hereby adopted shall be declared unconstitutional or otherwise invalid by the valid judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance or the Code hereby adopted. SECTION 6. The Code adopted hereby shall be changed to read as follows: Section 4-2: Add "Any dog which has been confined in the city pound pursuant to the provisions of this chapter shall be kept for a period of not less than seven days unless sooner claimed by the owner; provided, that no provision herein shall be construed to prohibit the destruction of critically injured or critically ill dogs for humane purposes." Section 4-16: Add "Provided, that no license tax shall be levied on any dog that is trained and serves as a guide dog for a blind person." Section 4-17: Delete last sencence. Add "The provisions of this section shall not be construed to prohibit a blind person accompanied by a guide dog from taking such dog with him into any place of public accommodation as defined by Section 36-124 of the Code of Virginia, as amended." Section 11-3: Add "No person shall maliciously activate a manual or automatic fire alarm in any building used for public assembly or for other public use, including, but not limited to, schools, theaters, stores, office buildings, shopping centers and malls, coliseums and arenas. Any person violating the provisions of this section, regardless of whether fire apparatus responds or not, shall be deemed guilty of a Class I misdemeanor." Section 12-12: Next -to -last line, detete "Class 3" and insert "Class I . " Section 16-9: Subsection (e), delete "Section 46.1-16" and insert "Section 46.1-16.01." Section 16-15: Delete as written and insert the following: "It shall be unlawful for any person to violate any provision of this chapter. Every person convicted of any such violation, for which no other penalty is provided, shall, for a first conviction thereof, be deemed guilty of a Class IV misdemeanor; for a second conviction within one year, such person shall be deemed guilty of a Class III misdemeanor; for a third or subsequent conviction within one year, such person shall be deemed guilty 0f a Class II misdemeanor."
