6. <br />Any person violating the provisions of this section shall be guilty <br />of a Class I misdemeanor." <br />Section 17-33: Delete subsection (b) as written and insert the <br />following: "(b) This section shall not apply to any person while in his <br />own place of abode or the curtilage thereof or to any police officers, <br />sergeants, sheriffs or deputy sheriffs. This section shall not apply to <br />any of the following individuals while in the discharge of their official <br />duties: (1) Carriers of the United States mail in rural districts, (2) <br />officers or guards of the penitentiary or other institutions or camps of the <br />state corrections system, and (3) conservators of the peace other than <br />notaries public." <br />Section 21-7: Subsection (a), first sentence, first line, delete <br />"arrested" and insert "detained by or in the custody of an arresting <br />officer". <br />Subsection (a), add "Any person so summonsed shall not be held in custody <br />after the issuance of such summons for the purpose of complying with the <br />requirements of Chapter 23 of Title 19.2 of the Code of Virginia. Reports <br />to the Central Criminal Records Exchange concerning such persons shall be <br />made after a disposition of guilt is entered as provided for in Section <br />O9.2-390 of the Code of Virginia." <br />Section 22-8: Delete last sentence as written and insert the following: <br />"Any such railroad company, receiver or trustee violating any of the <br />provisions of this section shall be fined not less than one hundred nor <br />more than five hundred dollars; provided, that the fine may be one hundred <br />dollars for each minute beyond the permitted time but the total fine shall <br />not exceed five hundred dollars. This section shall not apply when the <br />train is stopped due to breakdown, mechanical failure or emergency." <br />71 <br />
