2. <br />(b) The deposit, or any part thereof, may, at the option of the city, <br />• be applied on any obligation the consumer may owe the city in connection <br />with city gas. Until the account of such consumer with the city shall be <br />closed out, the deposit shall be kept unimpaired. When the account is closed <br />out, the balance, if any, shall be returned to the consumer or his personal <br />representative or assigns. <br />(c) The director of finance and city manager are authorized to enter <br />into agreements with responsible organizations to provide for a guaranty <br />of the account of individuals meeting established criteria, in lieu of such <br />deposit, in an amount equal to the deposit which would otherwise have been <br />required, provided such agreement in their judgment provides the city with <br />substantially equivalent security. <br />Section 12-10.1. Delinquent accounts; finance charge; <br />termination of service. <br />(a) All bills for gas service and other charges rendered pursuant to <br />this chapter shall be payable upon presentation, and shall be considered <br />to be in arrears if not paid prior to the rendering of the next monthly <br />billing. Any amount for which payment has not been received within thirty <br />days of the initial billing shall be subject to the imposition of a finance <br />• charge of one percent per month for each month until payment is made. <br />(b) Payments received,on any account shall be first applied to the <br />amount of any unpaid finance charge, then to amounts in arrears reducing <br />the oldest charges first, then to current billings. <br />(c) In addition to the finance charge imposed under subsection (b), <br />the director of finance may order the termination of service to any customer <br />whose account remains in arrears more than ten days after such customer has <br />been mailed a final notice, which notice shall plainly indicate that service <br />may be terminated if payment is not made. <br />Section 12-10.2. Charqe for bad checks. <br />Any customer whose check for payment of his account or any portion <br />thereof is returned by the financial institution on which drawn for <br />insufficient funds shall be subject to a charge of five dollars, which <br />charge shall be added to and become a Part of the account of such customer. <br />Section 12-11. Charge for restoring service. <br />For turning gas on again after it has been cut off for nonpayment, there <br />shall be a charge of twe-dellars- five dollars, payable in advance. <br />• <br />
