on a special permit request in an Architectural Design Control <br />District shall be made in writing no later than twelve days <br />prior to the date of the public hearing and any such comments <br />shall be made part of the public hearing record. The Board <br />of Architectural Review shall have at least fifteen days <br />for their review and comments. <br />Section 31-228.1. Exceptions and modifications as conditions <br />of special permits. <br />In granting any special permit or special use permit authorized b <br />,rovision of this chapter, the City Council may expand, modify, re <br />or otherwise grant exceptions to yard regulations, standards for higher <br />density, and time limit requirements imposed by any other provision of <br />this chapter, provided: <br />(1) That city council finds that such modification or exception <br />will be in harmony with the purposes and intent of this article, <br />and of the article under which such special permit or special <br />use permit is being sought; and <br />(2) That such modification or exception is necessary or desirable <br />in view of the particular nature, circumstances, location or <br />situation of the project which is the subject of such permit <br />(3) That no such modification or exception shall be authorized <br />to allow a use which is not otherwise allowed by special permit <br />or by right in the district in question. <br />The planning commission, in making its recommendations to City Council <br />concerning any permit application before it for consideration, may include <br />comments or recommendations regarding the granting or imposition of any <br />such modification or exceptions which the commission may deem necessary <br />or desirable. <br />The resolution adopted by City Council to grant any such special permit <br />or special use permit shall include any such exception or modification as <br />a specific condition of such permit. <br />
