Deferred by Council 11/6/78 <br />Revised 12/27/78 <br />AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />UNOPE14ED OAK RIDGE AVENUE <br />IN THE CITY OF CHARLOTTESVILLE <br />WHEREAS, proper notice that William Ivar Mawyer would make <br />application to the City Council of the City Of Charlottesville, <br />Virginia, to have the hereinafter described street closed, vacated <br />and discontinued was duly posted; and <br />WHEREAS, all owners abutting said street have been duly <br />notified; and <br />WHEREAS, application was made to the City Council, and pursuant <br />to the statutes in such cases made and provided, the Council <br />appointed viewers who have reported that no inconvenience would <br />result from such closing, vacating and discontinuance; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Charlottesville, Virginia, that the street located in said City, <br />described as follows, is hereby closed, vacated, and discontinued <br />as a public thoroughfare and right of way of the City, said street <br />not being needed for public use and travel: <br />• Unopened Oak Ridge Avenue, lying between Parcels 2,3 and 4 <br />on City Real Property Tax Map 24. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby <br />reserves unto itself and easment to maintain, repair or replace <br />an existing sanitary main located in the street right of way <br />herein vacated, which easement shall extend a distance of ten <br />feet in either direction from the center line of such existing <br />sewer line; and <br />PROVIDED FURTHER, that the City of Charlottesville likewise <br />reserves unto itself an easement ten feet in width along the <br />southern margin of the right of way herein vacated, for the <br />use of public pedestrian and bicycle traffic, and for the possible <br />future installation of a pathway designed to serve such traffic. <br />Adopted by the Council <br />January 16, 1979 <br />Copy Teste: ?� <br />• Clerk of the Council <br />
