91 The planning commission and the city council shall evaluate the following •criteria in order to minimize the potential adverse impact of such reloca- tion: (1) Preservation of the cross-sectional area of the floodway. (2) Minimization of adverse impact on the cross-sectional area of the flood plain. (3) Prevention of increased velocity of the stream. (4) Preservation of the holding capacity of the flood plain. (5) Minimization of adverse impact on downstream and upstream flood levels. (6) Preservation of the quality of the water. (7) Protection of the natural environment along the relocated stream channel. This shall include but not be limited to: a. Stabilization and slope of stream banks. b. Protection of existing and proposed vegetation; C. Prevention of adverse impact on wildlife. The applicant shall be required to provide data showing the extent to which the proposed project will adhere to such criteria at the time of submission of the special permit application. Copies of approved applica- tions for stream bed relocation or alteration shall be forwarded to both the State Water Control Board and the Federal Insurance Administration. • Section 31-121. Nonconforming uses. All uses in the floodway except those specifically mentioned in section 31-119 are considered permanently nonconforming. Section 31-122. Discontinuance of use. If the use of any structure which existed prior to the date of enact- ment of this article is discontinued for two consecutive years, any future use of the structure shall be considered a new use and shall comply with the requirements set forth in this article. Division 3. Documents, Warning and Disclaimer of Liability. Section 31-123. Documents to be available for public inspection.
