a <br />AN ORDINANCE <br />TO AMEND CHAPTER 31 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />BY ADDING A SECTION NUMBERED 31-279.1 RELATING TO THE <br />SUSPENSION OF TIME LIMITS ON PERMTS, CERTIFICATES <br />AND OTHER APPROVALS DURING LITIGATION. <br />BE IT ORDAINED by the Council of the City of Charlottesville <br />that Chapter 31 of the Code of the City of Charlottesville, 1976, <br />is amended by adding a section numbered 31-279.1, as follows: <br />Section 31-279.1. Suspension of time limits on permits, <br />certificates and other approvals <br />during litigation. <br />Whenever any provision of this chapter or of Chapters 5, 9, <br />or 26.1 of this code imposes a time limit upon the validity of a <br />permit, certificate, variance, site plan, plat or other official <br />approval granted thereunder and the validity of such permit, <br />certificate, variance, site plan, plat or other official approval <br />is raised as an issue in any judicial proceeding to which the city <br />or the recipient of such approval is a party, and such time limi- <br />tation is reached during the pendency of the judicial proceeding, <br />then such approval shall be extended to a date six months beyond <br />the date of a final, non -appealable order by a court of competent <br />jurisdiction terminating the litigation. <br />This section shall be applicable to approvals for which such <br />litiaation is pending at the date of adoption of this section. <br />Attester <br />Clerk of Council <br />Adopted by Council <br />February 2, 1981 <br />
