e <br />Adopted by Council <br />January 19, 1981 <br />Copy teste: <br />Kathleen Ro etter <br />Clerk of Council <br />AN ORDINANCE AFFIRMING THE CREATION OF A <br />SPECIAL ASSESSMENT DISTRICT <br />PURSUANT TO §§15.1-239 ET SEQ. OF THE CODE OF VIRGINIA; <br />ESTABLISHING THE PORTION OF PROJECT COSTS TO BE LEVIED <br />AS AN ASSESSMENT ON THE PROPERTIES IN SUCH DISTRICT; <br />RECITING THE FINDINGS OF CITY COUNCIL IN REGARD TO THE <br />BENEFITS ACCRUING TO PROPERTIES WITHIN SAID DISTRICT; <br />ESTABLISHING THE AMOUNT OF THE ASSESSMENT TO BE LEVIED <br />ON EACH SUCH PROPERTY; LEVYING SAID ASSESSMENTS <br />AND PROVIDING FOR THE TIME, MANNER AND TERMS <br />OF THE COLLECTION THEREOF <br />BE IT ORDINAED by the Council of the City of Charlottesville: <br />SECTION 1. The action of City Council taken at a meeting of May 15, <br />1978, creating a special assessment district comprising all properties <br />abutting on Main Street between the easterly margin of First Street on the <br />east and Preston Avenue on the west, is hereby ratified and affirmed. <br />SECTION 2. The Council finds and declares that the total cost of the <br />improvements to Main Street, including the construction or replacement of <br />sanitary and storm water sewer facilities, the replacement of street and <br />sidewalks with special paving materials, and the installation of lighting <br />and other permanent amenities including but not limited to benches and <br />other waste receptacles, is $306,171.00, and that $171,700.00 of such <br />total cost may lawfully be and should be apportioned to and assessed against <br />the parcels of real property and improvements thereon abutting such improve- <br />ments and comprising such district. <br />SECTION 3. The Council finds and declares that such improvements have <br />benefitted and will continue to benefit the properties comprising such <br />special assessment district by preserving or enhancing the values of such <br />properties, that the benefits thus accruing to such properties are directly <br />proportional to the assessed value of such properties, and that the amount <br />specified by Section 4 of this ordinance to be assessed against each such <br />property in no case exceeds the peculiar benefit accruing to such property <br />• for the improvements. <br />SECTION 4. The sum of $171,700.00 is hereby levied as a special <br />assessment for local improvements upon the properties comprising the <br />special assessment district referred to in Section 1 of this ordinance. <br />Such levy shall be apportioned among the parcels of real estate comprising <br />in the amounts hereinafter set forth. <br />MAP/PARCEL NO. <br />PROPERTY OWNERS & ADDRESS <br />OF PROPERTY SPECIAL ASSESSMENT <br />Roger H.
