• AN ORDINANCE <br />TO AMEND AND REORDAIN ARTICLE IX OF CHAPTER 13 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, 1976, <br />AS AMENDED, BY REPEALING §13-38, BY AMENDING 5913-35, 13-36, <br />13-37 AND 13-39, AND BY ADDING NEW SECTIONS NUMBERED 13-34.5 <br />AND 13-38.5, THE REPEALED, AMENDED AND NEW SECTIONS <br />PERTAINING TO THE CONDEMNATION OF DWELLINGS <br />UNFIT FOR HUMAN HABITATION. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia: <br />1. That section 13-38 of the Code of the City of Charlottesville, <br />1976, as amended, is hereby repealed. <br />2. That §§13-35, 13-36, 13-37 and 13-39 of the Code of the City <br />of Charlottesville, 1976, as amended, are amended and that such <br />Code is further amended by adding new sections numbered 13-34.5 and <br />13-38.5, as follows: <br />ARTICLE IX. DWELLINGS UNFIT FOR HUMAN HABITATION. <br />• Section 13-34. Grounds for condemnation of unfit <br />dwellings. <br />[remains as is] <br />Section 13-34.5. Notice of condemnation. <br />Whenever an inspection establishes that any of the grounds <br />listed in section 13-34 of this article exist, the enforcing officer <br />shall proceed with a notice of condemnation to the owner or owners <br />under section 13-3 of this chapter. A copy of any condemnation <br />notice or order issued under section 13-3 of this chapter and any <br />decision rendered under section 13-5 and 13-6 of this chapter <br />relating to such condemnation shall be sent by certified mail to <br />each tenant, if any, of the subject premises if the enforcing office <br />can with reasonable diligence ascertain the name of such tenant or <br />tenants If the enforcing officer has reason to believe that some- <br />one occupies such premises but, after reasonable diligence, cannot <br />ascertain such person's name, such copy or copies shall be sent <br />by regular mail to "Occupant" at the address of the subject property <br />Any condemnation notice or order issued under section 13-3 of this <br />. chapter shall clearly state that unless the grounds for condemnation <br />have been removed, the condemned dwelling or dwelling unit must be <br />vacated within a reasonable time not to exceed the earliest of: <br />
