AN ORDINANCE <br />• CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF ALBEMARLE STREET <br />WHEREAS, proper notice that Alexander B. Dotson would make <br />application to the City Council of the City of Charlottesville, <br />to have the hereinafter described street closed, vacated and <br />discontinued was duly posted; and <br />WHEREAS, all owners abutting said street have been duly <br />notified; and <br />WHEREAS, application was made to the City Council, and <br />pursuant to the statutes in such cases made and provided, the <br />Council appointed viewers who have reported that no inconvenience <br />would result from such closure, vacation and discontinuance; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Charlottesville, Virginia, that the said street located in <br />said City, described as follows, is hereby closed, vacated and <br />discontinued as a public thoroughfare of the City of Charlottes- <br />ville, Virginia, said street not being needed for public use and <br />travel: <br />• That portion of Albemarle Street from its intersection <br />with Dale Avenue and running in a southeasterly direction <br />for a distance of 73.14 feet, more or less, and bounded on <br />the west by Parcel 16 and on the east by the Southern <br />Railway property as shown on City Real Property Tax Map 31. <br />This portion lies immediately north of the portion of <br />Albemarle Street vacated by ordinance adopted October 20, <br />1980. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby <br />reserves unto itself perpetual easements ten feet in width on <br />either side of the centerlines of all water, sanitary sewer and <br />storm sewer lines or mains shown on plat to be recorded in the <br />Clerk's Office of the Circuit Court of the City of Charlottes- <br />ville. These easements shall include the perpetual right of <br />ingress and egress over the vacated area for the purpose of <br />installing, maintaining, repairing or replacing such utility <br />lines; and <br />PROVIDED, FURTHER, that the City of Charlottesville hereby <br />reserves unto itself a pedestrian easement to be shown on the <br />above-mentioned plat to be recorded in the aforesaid Clerk's Office. <br />This ordinance shall be effective upon recordation of the <br />aforesaid plat by petitioner or his successors in interest. <br />Approved by Council October 17, 1983 <br />erk ot Council <br />83-7-32 <br />
