• <br />• <br />• <br />AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF McELROY DRIVE <br />WHEREAS, proper notice that Peter R. Helweg and David R. <br />Dowell would make application to the City Council of the City of <br />Charlottesville, to have the hereinafter described street <br />closed, vacated and discontinued was duly posted and advertised; <br />and <br />WHEREAS, all owners abutting said street have been duly <br />notified; and <br />WHEREAS, application was made to the City Council, and <br />pursuant to the statutes in such cases made and provided, the <br />Council appointed viewers who have reported that no incon- <br />venience would result from such closure, vacation and <br />discontinuance; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Charlottesville, Virginia, that the said street located <br />in said City, described as follows, is hereby closed, vacated <br />and discontinued as a public thoroughfare of the City of <br />Charlottesville, Virginia, said street not being needed for <br />public use and travel: <br />That portion of McElroy <br />Lot 7 and Lot 27 on Tax <br />Woods Subdivision. <br />Drive situated between <br />Map 19 in Jefferson <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby <br />reserves unto itself perpetual easements ten feet in width on <br />either side of the centerlines of any water, sanitary sewer <br />and storm sewer lines or mains presently located in the area <br />being vacated, including the perpetual right of ingress and <br />egress over the vacated area for the purpose of installing, <br />maintaining, repairing or replacing such utility lines. <br />Approved by Council <br />October 15, 1984 <br />e c of Council <br />84-7-33 <br />
