. Section 31-28.1. Criteria for Group Residential Uses. <br />In addition to the standards otherwise applicable to special <br />permits, when evaluating special permit applications under <br />Section 31-28 that would allow residential occupancy �yrg oups of <br />more than four unrelated persons, the planning commission and <br />city council shall consider the following: <br />(a) Special needs of proposed residents for group living, <br />such as retardation, mental or physical illness, infirmity, <br />alcoholism, rehabilitation, or other similar special needs. <br />(b) Impacts of group living uses on the community including, <br />but not limited to, the following: <br />(1) Noise and congestion normally associated with the <br />type of use proposed. <br />(2) The reasonably anticipated state of maintenance and <br />care of the property based on the experience with other similar <br />uses in the city. <br />(3) The number of vehicles and personal trips to and <br />from the use and the times at which the trips are made, and the <br />possibility of on-site accomodation of such vehicles. <br />• (4) The number of residents to be housed in the <br />facility in relation to the amount of land and the size of the <br />structure devoted to the use. <br />(5) The relationship of the proposed use to existing <br />uses on adjacent properties and in the area. <br />Section 31-265.1. Special Provision for Continuation of <br />Certain Group Residential Uses. <br />(a) Notwithstanding the amendments to Sections 31-27 and 31- <br />28 effective September 1,1984, group residential uses lawfully in <br />existence in R-3 Residential Districts on that date shall not be <br />deemed to have been made non -conforming by virtue of those <br />amendments, but shall be considered conforming uses, as long as <br />they are not expanded or enlarged. However, enlargement or <br />expansion of any such use shall require a special permit as <br />provided by Section 31-28, and compliance within applicable off- <br />street parking and other requirements. <br />(b) Individual dwelling units or groups of dwelling units <br />existing and actually occupied by more than four unrelated per- <br />sons at any time during the eighteen months immediately preceding <br />September 1,1984, that: <br />0 <br />
