• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF YORKTOWN DRIVE <br />WHEREAS, proper notice that W. Douglas Gilpin, Jr. and <br />Lane Kneedler would make application to the City Council of <br />the City of Charlottesville, to have the hereinafter described <br />street closed, vacated and discontinued was duly posted and <br />advertised; and <br />WHEREAS, all owners abutting said street have been duly <br />notified; and <br />WHEREAS, application was made to the City Council, and <br />pursuant to the statutes in such cases made and provided, the <br />Council appointed viewers who have reported that no inconvenience <br />would result from such closure, vacation and discontinuance; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Charlottesville, Virginia, that the said street located in <br />said City, described as follows, is hereby closed, vacated and <br />discontinued as a public thoroughfare of the City of Charlottes- <br />ville, Virginia, said street not being needed for public use <br />and travel: <br />• That portion of Yorktown Drive between <br />1665 Brandywine Drive and 1667 Brandywine <br />Drive beginning at the northern curbline <br />of Brandywine Drive and extending approx- <br />imately 210 feet to the north, to the <br />boundary of City Real Property Tax Map <br />Parcel 41D-75. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby <br />reserves unto itself perpetual easements ten feet in width on <br />either side of the centerlines of any water, sanitary sewer <br />and storm sewer lines or mains presently located in the area <br />being vacated, including the perpetual right of ingress and <br />egress over the vacated area for the purpose of installing, <br />maintaining, repairing or replacing such utility lines. <br />This ordinance shall be effective upon recordation in the <br />Clerk's Office of the Charlottesville Circuit Court by Mr. <br />Kneedler or his successors in title of a duly approved sub- <br />division plat, recombining into a single lot Parcels 75, 81 <br />and the western portion of Parcel 85 on City Real Property Tax <br />Map 41D, and the portion of Yorktown Drive reverting to Mr. <br />Kneedler by virtue of the adoption of this ordinance. <br />• Approved by Council <br />June 18, 1984 <br />)�tm� el" <br />C rk of Council <br />84-7-19 <br />
