AN ORDINANCE TO AMEND AND REORDAIN
<br />§§31-127.1, 31-127.2, 31-128, 31-129, 31-130, 31-131, 31-136,
<br />31-137, 31-138, 31-139.1, 31-140.1, 31-140.2, 31-141,
<br />31-142, 31-143, 31-144, 31-145, 31-146, 31-147.1,
<br />AND 31-179, AS SEVERALLY AMENDED, OF THE
<br />CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AND
<br />FURTHER TO AMEND ARTICLE XVI OF CHAPTER 31 OF SUCH CODE BY
<br />ADDING SECTIONS NUMBERED 31-139.5 THROUGH 31-139.13, IN ORDER
<br />TO CREATE A DOWNTOWN ARCHITECTURAL DESIGN CONTROL DISTRICT,
<br />TO PROVIDE RESTRICTIONS ON THE CONSTRUCTION, RECONSTRUCTION,
<br />ALTERATION OR REMOVAL OF BUILDINGS, STRUCTURES, SPACES, SITES,
<br />LANDMARKS AND SIGNS WITHIN SUCH DISTRICT AND TO CREATE A
<br />DOWNTOWN BOARD OF ARCHITECTURAL REVIEW TO ADMINISTER
<br />SUCH RESTRICTIONS.
<br />BE IT ORDAINED by the Council of the City of Charlottesville,
<br />Virginia, that §§31-127.1, 31-127.2, 31-128, 31-129, 31-130, 31-131,
<br />31-136, 31-137, 31-138, 31-139.1, 31-140.1, 31-140.2, 31-141, 31-142,
<br />31-143, 31-144, 31-145, 31-146, 31-147.1 and 31-179, as severally
<br />amended, of the Code of the City of Charlottesville, are amended and
<br />reordained and that Article XVI of Chapter 31 of such Code is further
<br />amended by adding Sections 31-139.5 through 31-139.13, as follows:
<br />Section 31-127.1. Primary functions of boards and
<br />• commissions dealing with historic
<br />preservation.
<br />In carrying out the purposes of this chapter the following bodies
<br />shall exercise the respective functions hereinafter set forth:
<br />(a) The city council:
<br />(1) Create and make appointments to the historic land-
<br />marks commission, the board of architectural review and the
<br />downtown board of architectural review.
<br />(2) Adopt ordinances dealing with historic preservation.
<br />(3) Designate Arehiteeturai-Besign-eentrel district
<br />boundaries.
<br />(4) Designate historic landmarks and sites.
<br />(5) Designate other historically, architecturally or
<br />culturally significant structures and sites.
<br />(b) The planning commission:
<br />(1) Propose and recommend changes or modifications
<br />to this ordinance.
<br />(2) Propose and recommend historic district boundaries.
<br />(3) Review site plans for historic structures, sites
<br />and landmarks and structures within the historic district.
