• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />HARDY DRIVE <br />WHEREAS, proper notice that the Charlottesville Redevelopment <br />and Housing Authority would make application to the City Council <br />of the City of Charlottesville, to have the hereinafter described <br />street closed, vacated and discontinued was duly posted and <br />advertised; and <br />WHEREAS, all owners abutting said street have been duly <br />notified; and <br />WHEREAS, application was made to the City Council, and <br />pursuant to the statutes in such cases made and provided, the <br />Council appointed viewers who have submitted reports as to whether <br />any inconvenience would result from such closure, vacation and <br />discontinuance; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia, that the said street located in said City, described as <br />follows, is hereby closed, vacated and discontinued as a public <br />thoroughfare of the City of Charlottesville, Virginia, said <br />street not being needed for public use and travel: <br />• All of Hardy Drive from its entrance to Westhaven <br />Housing Project at Page Street to the terminus <br />of Hardy Drive at the northeast corner of the <br />Westhaven Housing Project. <br />• <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby <br />reserves unto itself a perpetual easement ten feet in width on <br />either side of the centerline of the gas, water and sewer lines <br />or mains presently located in the area being vacated, including <br />the perpetual right of ingress and egress over the vacated area <br />for the purpose of installing, maintaining, repairing or replacing <br />such utility lines. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall <br />send a copy of this ordinance with plat attached to the Clerk <br />of the Circuit Court for recordation in the current street closing <br />book. <br />Approved by Council <br />September 3, 1985 <br />�� - . <br />r c o Counci l <br />85-7-37 <br />
