• (d) Permits for cafes on the Main Street pedestrian mall <br />may contain such additional conditions and requirements as <br />council may deem necessary to ensure that their operation <br />and appearance are compatible with the atmosphere of the mall. <br />No more than one outdoor cafe shall be permitted in each <br />block of the mall. The portions of the mall having partial <br />frontage on Second Street, N.E. and on Preston Avenue shall be <br />considered separate blocks for this purpose. <br />• <br />(e) Operation of any such cafe shall comply with all <br />provisions of state health laws and regulations regarding the <br />service and preparation of food and, where applicable, the <br />regulations of the state alcoholic beverage control board. <br />(f) Within the designated area of a cafe, the operator <br />holding a permit under this section shall have the right to <br />limit access and occupancy only to bona fide paying customers <br />of his restaurant who are behaving in a lawful manner, and <br />shall have the same right to deny admission or service as he <br />exercises on his own premises. However, no person shall be <br />denied access or service to the cafe area on the basis of race, <br />religion, national origin, sex or physical handicap. <br />(g) As a condition of such permit, the cafe operator shall <br />indemnify the city and hold it harmless from all claims for <br />damages or injuries of any kind whatsoever arising out of or <br />caused by the location or operation of the cafe on the public <br />right-of-way of the city. The operator shall keep in force <br />and furnish the city with evidence of public liability insurance <br />coverage in the amount of at least three hundred thousand dollars <br />single limit coverage during all periods in which such cafe is <br />in operation. <br />(h) City council may revoke any permit granted hereunder, <br />after a hearing conducted at any regular meeting of the council, <br />provided the cafe operator has been notified of such hearing by <br />written notice delivered to his place of business at least five <br />days before such meeting if the council finds that the operator <br />is violating any of the terms of his permit or that the cafe <br />poses a threat to the public health, safety and welfare or <br />constitutes a public nuisance. <br />(i) The city zoning administrator shall be responsible <br />for receiving applications for cafe permits and forwarding <br />them to city council, and for monitoring compliance with the <br />requirements of this section. <br />Approved by Council <br />August 5, 1985 <br />A�� CIalt <br />CWX ot Council <br />85-7-32 <br />
