• AN ORDINANCE <br />TO AMEND THE ZONING DISTRICT MAP INCORPORATED <br />BY REFERENCE IN SECTION 31-4 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, BY CHANGING TO THE PLANNED UNIT DEVELOPMENT <br />(PUD) ZONING CLASSIFICATION THE PROPERTY LOCATED AT <br />THE END OF ROCK CREEK ROAD, EAST OF CHERRY AVENUE <br />AND SOUTH OF FOREST HILLS PARK, <br />DESIGNATED AS PARCEL 120 ON TAX MAP 24. <br />BE IT ORDAINED by the Council of the City of Charlottesville: <br />1. That the zoning district map, incorporated by reference <br />in X31-4 of the Code of the City of Charlottesville, 1976, as <br />amended, be amended by designating as a Planned Unit Development <br />zoning classification that lot or parcel of land located at the <br />end of Rock Creek Road, east of Cherry Avenue and south of Forest <br />Hills Park, designated as Parcel 120 on City Real Property Tax <br />Map 24, having approximately 50 feet of frontage on Rock Creek <br />Road and containing approximately 194,277 square feet of land, <br />• or 4.46 acres. <br />2. That such amendment be conditioned upon the following: <br />(a) That the property be developed with not more than <br />24 residential units, designed for sale as condominiums. <br />(b) That the development of such property be carried out in <br />conformity with the plans for development and related <br />documents and exhibits submitted as part of the <br />application for the PUD zoning designation, including <br />such modifications to such plans as may be required <br />by the city planning commission or the director of <br />planning for final approval thereof. <br />(c) That the appropriate documents for formation or <br />incorporation of a homeowners' association, for <br />ownership and maintenance of common spaces and <br />facilities be submitted for review and approval by <br />the city attorney and the department of community <br />development prior to final site plan approval. <br />(d) That development and construction on the property be <br />• carried out in conformity with all other applicable <br />federal, state or city code requirements and regulations. <br />Approved by Council 6u ` "4 <br />August 19, 1985 <br />rk of Council <br />85-7-33 <br />
