As Approved <br />July 15, 1985 <br />AN ORDINANCE <br />40 TO AMEND AND REORDAIN CHAPTER 25 <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, 1976, <br />AS AMENDED, TO ADD A NEW ARTICLE V. RELATING TO <br />VENDORS ON CITY STREETS AND SIDEWALKS <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia: <br />1. That Chapter 25 of the Code of the City of Charlottesville, <br />1976, as amended, be further amended and reordained to add a new <br />Article V., as follows: <br />ARTICLE V. STREET AND SIDEWALK VENDORS <br />Section 25-43. Findings and intent. <br />City Council finds and declares that: <br />(a) The primary purpose of the public streets and sidewalks <br />is for use by vehicular and pedestrian traffic; <br />. (b) Vending on certain public streets and sidewalks may promote <br />the public interest by contributing to an active and attractive <br />pedestrian environment; <br />(c) Reasonable regulation of street and sidewalk vending is <br />necessary to secure, preserve and promote safety, welfare, comfort, <br />convenience, trade and commerce in the City and among its inhabitants; <br />and <br />(d) The regulations contained in this article regulate certain <br />activities which are commercial in nature and are not intended to <br />restrict or prohibit pure speech or other conduct of individuals or <br />organizations that is protected by the Constitution of the United <br />States and the Commonwealth of Virginia. <br />Section 25-44. Definitions. <br />For purposes of this article, the following definitions shall <br />apply: <br />(a) "Stand" means any newsstand, table, showcase, bench, booth, <br />rack, cart, pushcart, wagon, stall or any other fixture or device <br />or wheeled vehicle which may be moved without the assistance of a <br />motor and which is not required to be licensed and registered by the <br />Division of Motor Vehicles, used for the displaying, storing or <br />transporting of articles offered for sale by a vendor. <br />-1- <br />
