As Approved July 15, 1985 AN ORDINANCE 40 TO AMEND AND REORDAIN CHAPTER 25 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, 1976, AS AMENDED, TO ADD A NEW ARTICLE V. RELATING TO VENDORS ON CITY STREETS AND SIDEWALKS BE IT ORDAINED by the Council of the City of Charlottesville, Virginia: 1. That Chapter 25 of the Code of the City of Charlottesville, 1976, as amended, be further amended and reordained to add a new Article V., as follows: ARTICLE V. STREET AND SIDEWALK VENDORS Section 25-43. Findings and intent. City Council finds and declares that: (a) The primary purpose of the public streets and sidewalks is for use by vehicular and pedestrian traffic; . (b) Vending on certain public streets and sidewalks may promote the public interest by contributing to an active and attractive pedestrian environment; (c) Reasonable regulation of street and sidewalk vending is necessary to secure, preserve and promote safety, welfare, comfort, convenience, trade and commerce in the City and among its inhabitants; and (d) The regulations contained in this article regulate certain activities which are commercial in nature and are not intended to restrict or prohibit pure speech or other conduct of individuals or organizations that is protected by the Constitution of the United States and the Commonwealth of Virginia. Section 25-44. Definitions. For purposes of this article, the following definitions shall apply: (a) "Stand" means any newsstand, table, showcase, bench, booth, rack, cart, pushcart, wagon, stall or any other fixture or device or wheeled vehicle which may be moved without the assistance of a motor and which is not required to be licensed and registered by the Division of Motor Vehicles, used for the displaying, storing or transporting of articles offered for sale by a vendor. -1-
