(b) "Vendor" means any person, including an employee or agent • of another, engaged in the selling, or offering for sale, of food, beverages or merchandise on any public street or sidewalk, from a stand or from his or her person. Section 25-45. Applicability. This article shall not apply to vending in streets from motor vehicles, which is governed by Chapter 19 of this Code, nor shall it apply to the operation of outdoor cafes, which is governed by section 25-28.1 of this Code, nor shall it apply to boxes for the vending of newspapers. Section 25-46. Permitted locations for vending in public streets. (a) Generally. Vending on public streets is prohibited except in districts designated as business districts under the city zoning ordinance. (b) Adjacent Businesses. Licensed businesses who occupy buildings on property in a business district adjacent to a public street or right-of-way may vend or display merchandise on stands, . or place flower boxes or other decorative objects, within the three feet of the public sidewalk immediately adjacent to the property they occupy. However, such stands, displays or decorative objects shall not be placed within five feet of an intersecting sidewalk, street or alley. Within the Architectural Review District and the Downtown Architectural Review District, the design and appearance of such stands or decorative objects shall be subject to review by the appropriate board of architectural review as provided in section 25-51. (c) Other Vendors. Vendors other than adjacent businesses may only locate stands on any sidewalk location in a B-3 or B-4 business district where they are: (1) Not within the three feet reserved for use by adjacent businesses as provided in paragraph (b) of this section; (2) Not impeding access to the entrance to any adjacent building or driveway; (3) Not occupying more than half of the available sidewalk width or four feet of such sidewalk • width, whichever is the lesser; and -2-
