(b) "Vendor" means any person, including an employee or agent <br />• of another, engaged in the selling, or offering for sale, of food, <br />beverages or merchandise on any public street or sidewalk, from a <br />stand or from his or her person. <br />Section 25-45. Applicability. <br />This article shall not apply to vending in streets from motor <br />vehicles, which is governed by Chapter 19 of this Code, nor shall <br />it apply to the operation of outdoor cafes, which is governed by <br />section 25-28.1 of this Code, nor shall it apply to boxes for the <br />vending of newspapers. <br />Section 25-46. Permitted locations for vending in public <br />streets. <br />(a) Generally. Vending on public streets is prohibited except <br />in districts designated as business districts under the city zoning <br />ordinance. <br />(b) Adjacent Businesses. Licensed businesses who occupy <br />buildings on property in a business district adjacent to a public <br />street or right-of-way may vend or display merchandise on stands, <br />. or place flower boxes or other decorative objects, within the three <br />feet of the public sidewalk immediately adjacent to the property <br />they occupy. However, such stands, displays or decorative objects <br />shall not be placed within five feet of an intersecting sidewalk, <br />street or alley. Within the Architectural Review District and the <br />Downtown Architectural Review District, the design and appearance <br />of such stands or decorative objects shall be subject to review <br />by the appropriate board of architectural review as provided in <br />section 25-51. <br />(c) Other Vendors. Vendors other than adjacent businesses <br />may only locate stands on any sidewalk location in a B-3 or B-4 <br />business district where they are: <br />(1) Not within the three feet reserved for use by <br />adjacent businesses as provided in paragraph (b) <br />of this section; <br />(2) Not impeding access to the entrance to any adjacent <br />building or driveway; <br />(3) Not occupying more than half of the available <br />sidewalk width or four feet of such sidewalk <br />• width, whichever is the lesser; and <br />-2- <br />
