AN ORDINANCE • TO AMEND AND REORDAIN CHAPTER FOUR OF THE CODE OF TEE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, TO ENACT A LEASH LAW FOR DOGS, TO INCREASE CERTAIN DOG LICENSE TAXES, TO PROHIBIT THE USE OF ANIMAL LEG -HOLD TRAPS, TO REQUIRE OWNERS TO PAY CERTAIN POUND FEES, TO GIVE THE HEALTH DISTRICT DIRECTOR CERTAIN DISCRETION REGARDING CONFINEMENT OF ANIMALS WHICH HAVE BITTEN PERSONS, TO ESTABLISH AND ADJUST VARIOUS PENALTIES AND TO MAKE CERTAIN HOUSEKEEPING AMENDMENTS. BE IT ORDAINED by the Council of the City of Charlottesville, Virginia: That Chapter Four of the Code of the City of Charlottesville, 1976, as amended, is hereby amended and reordained as follows: CHAPTER 4. ANIMALS AND FOWL • ARTICLE I. GENERAL. Section 4-1. Definitions. The following words, terms and phrases, when used in this chapter, shall have the following meanings ascribed to them in this section: Animal control officer. Any person sworn as such officer by the chief of police. Cat. Every cat regardless of sex or age. Dog. Every dog regardless of sex or age. Leash. A physical restraint approximately six feet in length, made of leather, chain or other suitable material, one end of which is attached to the collar of an animal and the other end of which is intended to be held by a strong and responsible person or attached to an immovable object. Owner. Every person having right of property or custody in a dog or cat, or who keeps or harbors a dog or cat, or has a dog or cat in his or her care;-er-wke-aete-as-a-enetediaa-a€-a-deg. To run at large or running at large. To roam, loiter, walk, run or be on or off the premises of the owner without being fenced, caged, physically carried er, held by leash by a person thoroughly • capable both physically and mentally of controlling the deej animal, or within the immediate voice control of the owner.
