Section 4-2. City pound. <br />The Charlottesville -Albemarle S.P.C.A. shelter shall serve <br />as the City pound for the purposes of this chapter. Any dog or cat <br />which has been confined in the City pound pursuant to the provisions <br />of this chapter shall be kept for a period of not less then seeem <br />five days unless sooner claimed by the owner; provided, that no <br />provision herein shall be construed to prohibit the destruction of <br />critically injured or eritieally ill dogs or cats for humane purposes. <br />Section 4-3. Dangerous animals. <br />(a) No person shall suffer or permit any animal belonging to <br />him or her or under his or her control and known or reasonably <br />suspected of being dangerous to go run at large in the City or be <br />kept in the City at any time except in strict confinement in such <br />manner as to be safe for the public at large or any person who may <br />have occasion to go on the premises on which such animal is kept. <br />Section 4-4. Destructive animals. <br />• (a) No person shall suffer or permit any animal belonging to <br />him or her or under his or her control to go upon the land of any <br />other person and damage or destroy any garden, shrub, grass or <br />other property thereon. <br />(b) Any person owning property which is damaged or destroyed <br />by any violation described in the foregoing paragraph may enter kis <br />a_ complaint by a warrant issued against the owner or custodian of <br />the animal involved and the complaint shall be heard by the judge <br />of the general district court as all other complaints under criminal <br />warrants are heard. Upon conviction, the owner shall be subject <br />to a fine for the commission of a Class IV misdemeanor with a <br />minimum fine of $10.00. Upon a second conviction within the-geried-ef <br />one year of any offense under this section involving the same animal, <br />in addition to imnosina a fine for the commission of a Class IV <br />misdemeanor, with a minimum fine of $10.00, the judge a€ -the -general <br />distr}et-eeurt shall order the owner or custodian of such animal <br />to take it into custody and to confine it in such a way that it <br />will not be permitted to run at large at any time. Upon the failure <br />of such owner or custodian to comply with this such order, such <br />animal shall be seized by the chief of police or his or her duly <br />authorized representative and humanely destroyed or placed for <br />adoption outside of the City. <br />• <br />
