ARTICLE III. Facilities, Service Requirements and <br />Technical Standards <br />• Section 3-1. General Characteristics and Maintenance of <br />Existing System. <br />During the term of this franchise the Company shall <br />maintain in continuous good working order throughout the franchise <br />area a system having at least the same channel capacity, antennas <br />and satellite reception capability, signal quality and degree of <br />reliability as that in place on the effective date of the <br />franchise. <br />Section 3-2. New Facilities Required. <br />Within six months of the effective date of this franchise the <br />Company shall install the following new facilities and equipment: <br />A. Replacement signal processors of modular, solid-state <br />design as described on page 8 of the Company's proposal of <br />March 1, 1985 to the City. <br />B. Standby power sufficient to allow the continuous <br />operation of its headend for a period of at least two hours in the <br />event of an outage of its regular electric power service. <br />C. Modifications to its headend facilities to permit an <br />• audio override on all channels for use by public safety <br />authorities in the event of a public emergency. <br />Section 3-3. Signal Carriage and Service Tiers. <br />A. Local regulation of cable system signal carriage having <br />been preempted by the Act and FCC regulations, the City will not <br />require the Company to transmit any particular audio or video <br />station or signal during the term of the franchise. <br />B. The Company is presently offering cable services as <br />indicated below. The Company reserves the right during the <br />Franchise term to add new services and replace services or <br />otherwise modify its channel lineup, but will maintain the mix, <br />quality and level of service, and the broad categories of video <br />programming, shown below. <br />Basic Service Tier <br />(1) Local television broadcast signs, such as Channel 29, <br />Charlottesville; Channels 6, 8, 12, Richmond; Channel 3, <br />Harrisonburg. <br />(2) Local educational television broadcast signals, such as <br />Channel 51, Harrisonburg/Staunton. <br />-14- <br />
