. B. The Company shall not interfere with efforts by its <br />subscribers, to record audio and video signals they receive over <br />the Company's system for their personal use, to the extent <br />permitted by Federal copyright laws and consistent with the <br />Company's encoding technology. <br />C. The Company shall distribute to all subscribers a written <br />explanation of the extent to which its signals, converters or <br />other aspects of its system are incompatible with the normal <br />functions of commercially available VCRs. <br />Section 4-9. Protection of Subscriber Privacy. <br />The Company shall comply in all respects with Section 631 of <br />the Act regarding protection of subscriber privacy, and shall not <br />require subscribers to waive notices or other protections provided <br />by that section as a condition of obtaining service. The Company <br />specifically agrees to delete from its service application form <br />the waiver of confidentiality currently contained thereon. <br />Section 4-10. Termination of Subscribers' Service. <br />The Company may terminate service to any subscriber who is <br />more than thirty days delinquent in payment of monthly service <br />fees or other obligations to the Company, provided it has first <br />given the subscriber written notice of the intended termination <br />• date, which shall be not less than ten additional days after <br />the mailing of such notice. Upon payment in full of a sub- <br />scriber's delinquent account, applicable reconnection charges, <br />and appropriate advance monthly fees, the Company shall reinstate <br />the subscriber's service. <br />C� <br />J <br />Section 4-11. Late Charge. <br />The Company may add a late charge of $1.00 or 1%, whichever <br />is greater to any subscriber account more than one month past due. <br />Such charge may not be imposed on any amount which is found not to <br />be due or owing. <br />Section 4-12. Company Rules and Regulations. <br />The Company may publish and enforce such other rules, <br />regulations and conditions of service as it may deem appropriate, <br />provided they are not inconsistent with this ordinance, the Act or <br />other applicable law. The Company shall provide the City Manager <br />with a copy of all such rules, regulations or conditions within <br />ten days after their adoption. <br />-21- <br />
