• • • AN ORDINANCE CLOSING, VACATING AND DISCONTINUING A PORTION OF RAILROAD AVENUE WHEREAS, proper notice that James Harvey Miller, David Y. Miller, Pauline M. Leake and Earl C. Leake would make application to the City Council of the City of Charlottes- ville to have the hereinafter described street closed, vacated and discontinued was duly posted and advertised; and WHEREAS, all owners abutting said street have been duly notified; and WHEREAS, application was made to the City Council, and pursuant to the statutes in such cases made and provided, the Council appointed viewers who have submitted reports whether any inconvenience would result from such closure, vacation and discontinuance; now, therefore, BE IT ORDAINED by the Council of the City of Charlottes- ville, Virginia that the said portion of the street located in said City, described as follows, is hereby closed, vacated and discontinued as a public thoroughfare of the City of Charlottesville, Virginia, said portion of the alley not being needed for public use and travel: That portion of Railroad Avenue adjacent to Parcels 1 and 2 on City Real Property Tax Map 21. PROVIDED, HOWEVER, that the City of Charlottesville hereby reserves unto itself a perpetual easement ten feet in width on either side of the centerline of any water, gas, sanitary or storm sewer mains presently located in the area being vacated, including the perpetual right of ingress and egress over the vacated area for the purpose of installing, maintaining, repairing or replacing such utility lines or mains. BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street closing book.
