• AN ORDINANCE <br />TO AMEND CHAPTER 5 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />TO AMEND SECTION 5-14 FOR HOUSEKEEPING PURPOSES AND <br />TO ADD A NEW ARTICLE VII <br />TO PROVIDE FOR THE REMOVAL, REPAIR OR <br />SECURING OF UNSAFE BUILDINGS. <br />BE IT ORDAINED by the Council of the City of Charlottes- <br />ville, Virginia: <br />That Chapter 5 of the Code of the City of Charlottesville, <br />1976, as amended, is hereby further amended and reordained, to <br />amend section 5-14 and to add a new article, numbered VII, as <br />follows: <br />Sec. 5-14. Board of appeals. <br />There is hereby created a Building Code Board board of <br />Appeals appeals pursuant to Volume I -- New Construction Code, <br />of the Virginia Uniform Statewide Building Code section 126.-0 of <br />the BOCA Basic Building Code. The board of appeals shall consist <br />of five (5) members qualified as provided in the BOCA Basic <br />. National Building Code and such members shall serve for terms of <br />five (5) years each. The jurisdiction of the board of appeals <br />shall be established by the Statewide Building Code and may be <br />expanded by local ordinance. <br />ARTICLE VII. CONDEMNATION. <br />Sec. 5-34. Inspection for condemnation purposes. <br />The jurisdiction of the building official is hereby expanded <br />to include inspection not only for enforcement of Volumes I and <br />II of the Virginia Uniform Statewide Building Code generally, but <br />to include inspection specifically with a view toward condem- <br />nation under this article if grounds for condemnation are found. <br />Sec. 5-35. Grounds for condemnation of buildings, walls and <br />other structures. <br />Any building, wall or other structure which shall be found <br />by the building official or his or her designee to have any of <br />the following defects shall be condemned as unfit for human use <br />or habitation: <br />(a) One which is so damaged, decayed, dilapidated, unsani- <br />tary, unsafe or vermin -infested that it creates a serious hazard <br />1 <br />
