• AN ORDINANCE TO AMEND CHAPTER 5 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, TO AMEND SECTION 5-14 FOR HOUSEKEEPING PURPOSES AND TO ADD A NEW ARTICLE VII TO PROVIDE FOR THE REMOVAL, REPAIR OR SECURING OF UNSAFE BUILDINGS. BE IT ORDAINED by the Council of the City of Charlottes- ville, Virginia: That Chapter 5 of the Code of the City of Charlottesville, 1976, as amended, is hereby further amended and reordained, to amend section 5-14 and to add a new article, numbered VII, as follows: Sec. 5-14. Board of appeals. There is hereby created a Building Code Board board of Appeals appeals pursuant to Volume I -- New Construction Code, of the Virginia Uniform Statewide Building Code section 126.-0 of the BOCA Basic Building Code. The board of appeals shall consist of five (5) members qualified as provided in the BOCA Basic . National Building Code and such members shall serve for terms of five (5) years each. The jurisdiction of the board of appeals shall be established by the Statewide Building Code and may be expanded by local ordinance. ARTICLE VII. CONDEMNATION. Sec. 5-34. Inspection for condemnation purposes. The jurisdiction of the building official is hereby expanded to include inspection not only for enforcement of Volumes I and II of the Virginia Uniform Statewide Building Code generally, but to include inspection specifically with a view toward condem- nation under this article if grounds for condemnation are found. Sec. 5-35. Grounds for condemnation of buildings, walls and other structures. Any building, wall or other structure which shall be found by the building official or his or her designee to have any of the following defects shall be condemned as unfit for human use or habitation: (a) One which is so damaged, decayed, dilapidated, unsani- tary, unsafe or vermin -infested that it creates a serious hazard 1
