0 <br />• <br />• <br />to the health or safety of the users or occupants thereof or of <br />the public; or <br />(b) One which lacks illumination, ventilation, sanitation <br />or exit facilities adequate to protect the health or safety of <br />the users or occupants thereof or of the public; or <br />(c) One which because of its general condition, vacancy or <br />location is unsanitary, poses a fire hazard or is otherwise <br />dangerous to the health or safety of the users or occupants <br />thereof or of the public. <br />Sec. 5-36. Service of notice of condemnation. <br />(a) Whenever an inspection establishes that any of the <br />grounds listed in section 5-35 above exists, the enforcing <br />officer, as designated by the building official, shall proceed <br />with a notice of condemnation to the owner or owners pursuant to <br />section 109.3 of Volume II of the Virginia Uniform Statewide <br />Building Code. <br />(b) Such notice shall be served upon the owner or owners of <br />record, or an executor or administrator of an estate or trustee <br />of a land trust, if applicable, or the owner's agent who has been <br />identified in writing by the owner to the enforcing officer as <br />having charge, care or control of the owner's building, wall or <br />other structure, by hand delivery or at the last known address by <br />certified mail, return receipt requested. <br />(c) Should delivery of such notice of condemnation be <br />refused or unclaimed, the enforcing officer may attempt service <br />by delivering the same and subsequent notices and orders per- <br />taining to the violations as indicated in such initial notifica- <br />tion to a sheriff or law enforcement officer for execution as <br />provided for service of process in title 8.01 of the Code of <br />Virginia, 1950, as amended. <br />(d) In the event that such attempted service of the initial <br />notice of condemnation by a sheriff or law enforcement officer is <br />unsuccessful, or if the identity or whereabouts of such person is <br />unknown and cannot be ascertained by the enforcing officer in the <br />exercise of reasonable diligence, the enforcing officer will <br />cause such notice to be posted in a conspicuous place on the <br />building, wall or other structure and such procedure shall be <br />deemed the equivalent of personal notice to the owner. <br />Sec. 5-37.
