• the owner to remove or restore the building, wall or other <br />structure, but shall not allow the owner the option to secure it. <br />(d) Any such court order to remove or restore the building, <br />wall or other structure shall provide that if the owner does not <br />comply, then the city shall cause the building, wall or other <br />structure to be demolished and the premises restored to a safe <br />and sanitary condition, at the expense of the owner, without the <br />necessity for further court approval. <br />(e) In the event of demolition by the city or its agents, <br />the cost thereof, together with an administrative handling charge <br />of one hundred dollars (5100.00), shall be billed to the property <br />owner and, if not paid, shall be added to, and collected in the <br />same manner as, the real estate tax on such property. In <br />addition, the city attorney may seek judgment for money to the <br />extent of the cost of such removal plus the administrative <br />handling charge. The city may sell or otherwise dispose of any <br />material portion of any demolished building, wall or other <br />structure. If the city sells any part of the demolished <br />building, wall or other structure, it shall credit the proceeds <br />of such sale first against the administrative handling charge, <br />then against the costs of demolition and restoration of the <br />premises, and any balance remaining shall be disbursed as <br />directed by the circuit court. <br />• Sec. 5-46. Emergency action. <br />(a) Whenever the enforcing officer finds that an emergency <br />exists which requires immediate action to protect the health and <br />safety of the occupants or users of a particular building, wall <br />or other structure, he or she may issue an order reciting the <br />existence of the emergency and requiring emergency action to be <br />taken as deemed necessary to meet the emergency. Service shall <br />be made pursuant to section 5-36 above. <br />(b) Regardless of other provisions of this chapter, and <br />regardless of whether the owner can be served immediately with <br />the order, such order shall take effect immediately. Any person <br />to whom such order is directed shall comply therewith immedi- <br />ately; however, upon petition filed with the enforcing officer, <br />such person shall be afforded a hearing before the Building Code <br />Board of Appeals within forty-eight (48) hours. After such <br />hearing, depending upon its findings, the Building Code Board of <br />Appeals shall affirm, modify or revoke such order. <br />(c) Upon issuance of an emergency order, the enforcing <br />officer shall placard the premises immediately, notwithstanding <br />the restrictions of section 5-41 above relating to appeals. <br />(d) When, in the opinion of the code official, there is <br />• immediate danger of collapse or failure of a building, wall or <br />7 <br />
