• other structure, or any part thereof, which would endanger life, <br />or when grounds of condemnation exist which create an immediate, <br />serious and imminent threat to the life and safety of the occu- <br />pants or users, the code official may cause the necessary work to <br />be done to the extent permitted by the city manager to make such <br />building, wall or other structure temporarily safe, whether or <br />not legal action to force compliance with this chapter has begun. <br />Such work may include, if necessary to achieve temporary safety, <br />partial or even total demolition. All costs of such emergency <br />work shall be billed to the owner and, if not paid, assessed and <br />collected as provided in section 5-45(e) above. <br />Sec. 5-47. Additional requirements applicable only to <br />residential buildings. <br />(a) It shall be unlawful for the owner of any residential <br />building which is unoccupied at the time of service of a notice <br />of condemnation or emergency order to allow such building to <br />become occupied, whether or not by agreement with the owner and <br />whether or not for compensation, unless and until such building <br />is no longer under a notice or, order of condemnation or emergency <br />order. <br />(b) In the event the enforcing officer serves a notice of <br />condemnation on an owner of a residential building which he or <br />. she has reason to believe is occupied, whether or not by agree- <br />ment with the owner and whether or not for compensation, such <br />enforcing officer shall send copies of all official notices, <br />orders and any other correspondence which is directed to the <br />owner to any and all such occupant(s) at the premises address. <br />If the enforcing officer cannot, in the exercise of reasonable <br />diligence, ascertain the identity of any occupant, or if the <br />number of occupants is believed to exceed five (5), it shall be <br />sufficient to deliver or mail to the premises, a sufficient <br />number of copies of all such notices, orders and any other cor- <br />respondence, addressed to "Occupant", as is calculated to be <br />likely to reach all occupants. Minor children living with adults <br />need not be sent separate copies nor shall they be counted to <br />determine whether the number of occupants exceeds five (5). <br />• <br />(c) No notice of condemnation, as distinguished from an <br />emergency order, which is served upon the owner of an <br />occupied residential building, shall require removal, securing or <br />any restoration which would necessitate the vacating of the <br />building to be carried out prior to the earliest of: <br />(i) the date by which all current occupants have <br />voluntarily vacated the structure; or <br />(ii) the end of the current lease term of all current <br />occupants; or <br />L <br />
