September 26, 1988 <br />• AN ORDINANCE <br />REGULATING NOISE CONTROL <br />WITHIN THE CITY OF CHARLOTTESVILLE. <br />BE IT ORDAINED by the Council of the City of Charlottes- <br />ville, Virginia, that the Code of the City of Charlottesville, <br />1976, as amended, is hereby amended by adding a new chapter <br />numbered 16.2 to read as follows: <br />CHAPTER 16.2 <br />NOISE CONTROL - PROVISIONAL <br />Sec. 16.2-1. Short title; scope. <br />This chapter may be cited as the "Provisional Noise Control <br />Ordinance of the City of Charlottesville." It shall be <br />applicable to the control of noises originating within any <br />residential zone within the city limits, or originating within <br />200 feet of any boundary of any residential zone within the city <br />limits. <br />Sec. 16.2-1.1. Declarations of findings and policy. <br />The City Council hereby finds and declares that <br />• unreasonably loud and disturbing noise is a serious hazard to <br />the public health, welfare, peace and safety, and the quality of <br />life; that the people have a right to and should be ensured an <br />environment free from such noise that may jeopardize the public <br />health, welfare, peace and safety or degrade the quality of <br />life; and that it is the policy of the city to prevent such <br />unreasonably loud and disturbing noise. <br />• <br />Sec. 16.2-2. Definitions. <br />The following terms, when used in this chapter, shall have <br />the meanings hereinafter ascribed to them, unless otherwise <br />clearly indicated by the context: <br />(a) Daytime. The hours from 6 A.M. to 10 P.M. during any <br />single calendar day. <br />(b) Emergency. Any occurrence or set of circumstances <br />involving actual or imminent physical trauma or property damage <br />which demands immediate action. <br />(c) Emergency work. Any work performed for the purpose of <br />preventing or alleviating the physical trauma or property damage <br />threatened or caused by an emergency. <br />1 <br />
