• AN ORDINANCE <br />TO AMEND AND REORDAIN CHAPTER 21.1, PURCHASING, OF THE CODE OF <br />THE CITY OF CHARLOTTESVILLE, VIRGINIA <br />TO CONFORM THE LOCAL ORDINANCE WITH STATE LAW REQUIREMENTS <br />AND MAKE OTHER HOUSEKEEPING CHANGES <br />BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that Chapter 21.1, Purchasing, of the <br />Code of the City of Charlottesville, 1976, as amended, is hereby <br />further amended and reordained as follows: <br />ARTICLE I. IN GENERAL. <br />Sec. 21.1. Purpose. <br />The purpose of this chapter is to provide for the fair <br />treatment of all persons involved in purchasing by the city, to <br />maximize the purchasing value of public funds in procurement, to <br />provide safeguards for maintaining a procurement system of <br />quality and integrity, and to conform to the requirements of the <br />Virginia Public Procurement Act, section 11-35 et seq. of the <br />Code of Virginia, 1950, as amended which act enunciates Virginia <br />nubl c Qolicies pertaining to governmental procurement from <br />• nongovernmental sources. <br />Sec. 21.1-2. Application. <br />(a) This chapter applies to every contract for the procure- <br />ment from a nongovernmental source of goods, services insurance <br />or construction entered into by the city involving an expenditure <br />of public funds irrespective of their source. <br />(b) When procurement involves the expenditure of federal <br />assistance or contract funds, such procurement shall be conducted <br />in accordance with all applicable mandatory federal laws and <br />regulations which are not reflected in this chapter. Nothing in <br />this chapter shall prevent the city from complying with the terms <br />and conditions of any grant, gift or bequest if such terms and <br />conditions are otherwise consistent with law. <br />Sec. 21.1-3. Definitions. <br />For the purposes of this chapter, the following words and <br />phrases shall have the meanings respectively ascribed to them by <br />this section, unless another meaning is clearly indicated by the <br />context in which they are used: <br />Competitive negotiation.
