AN ORDINANCE <br />TO AMEND ARTICLE V OF CHAPTER 25 OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, 1976, AS AMENDED, <br />RELATING TO STREET AND SIDEWALK VENDORS, <br />BY REPEALING SECTIONS 25-46 THROUGH 25-61, <br />AND ADDING SECTIONS 25-45.1 THROUGH 25-45.7. <br />BE IT ORDAINED by the Council of the City of <br />Chartlottesville, Virginia, that: <br />1. Sections 25-46 through 25-61 of Chapter 25 of the <br />Charlottesville City Code of 1976, as amended, relating to street <br />and sidewalk vendors, are hereby repealed. <br />2. The Charlottesville City Code of 1976 is hereby amended <br />by adding new sections tosbe numbered sections 25-45.1 through <br />25-45.7, so that Article V of Chapter 25 shall read as follows: <br />ARTICLE V. STREET AND SIDEWALK VENDORS. <br />Sec. 25-43. Findings and intent. <br />City Council finds and declares that: <br />(a) The primary purpose of the public streets and sidewalks <br />is for use by vehicular and pedestrian traffic; <br />(b) Vending on certain public streets and sidewalks may <br />promote the public interest by contributing to an active and <br />attractive pedestrian environment; <br />(c) Reasonable regulation of street and sidewalk vending is <br />necessary to secure, preserve and promote safety, welfare, <br />comfort, convenience, trade and commerce in the city and among <br />its inhabitants; and <br />(d) The regulations contained in this article regulate <br />certain activities which are commercial in nature and are not <br />intended to restrict or prohibit pure speech or other conduct of <br />individuals or organizations that is protected by the <br />Constitutions of the United States and the Commonwealth of <br />Virginia. <br />Sec. 25-44. Definitions. <br />For purposes of this article, the following definitions <br />shall apply: <br />(a) "Stand" means any newsstand, table, showcase, bench, <br />booth, rack, cart, pushcart, wagon, stall or any other fixture or <br />device or wheeled vehicle which may be moved without the <br />assistance of a motor and which is not required to be licensed <br />and registered by the division of motor vehicles, used for the <br />displaying, storing or transporting of articles offered for sale <br />by a vendor. <br />1 <br />
