(b) "Vendor" means any person, including an employee or <br />agent of another, engaged in the selling, or offering for sale, <br />of food, beverages or merchandise on any public street or <br />sidewalk, from a stand or from his or her person. <br />Sec. 25-45. Applicability of article. <br />This article shall not apply to vending in streets from <br />motor vehicles, which is governed by chapter 19 of this Code, nor <br />shall it apply to the operation of outdoor cafes, which is <br />governed by section 25-28.1 of this Code, nor shall it apply to <br />boxes for the vending of newspapers. <br />fal Generally, Vending on public streets and sidewalks is <br />prohibited except in districts desianated as business district.�__ <br />under the city Zonina Ordinance, <br />•) Vendor stands,1 • I • may not • - located where <br />fl) Impede access to the entrance to any adiacent building�-- <br />or driveway: <br />(2) Occupy more than half of the available sidewalk width <br />or fourfeet of such sidewalk width.whichever <br />(3) Are within ten feet of a fire hydrant. oublic <br />telephone. fire escape. driveway of a fire or police station or <br />f4l Are within the portion of any street intended for the <br />use of motor ve+ <br />(5) Are within lanes on the downtown mall reserved for_U2P <br />by fire and emergency vehicles, For purposes of this article. <br />such lanes shall be designated on a map or plan approved by City <br />Council and • - ! + the office of the city zonincradministrator, <br />fal Size of stands. No vendor's stand shall exceed eight <br />feet in lenath. eight feet in width or eight feet in height. <br />(b) Hours of operation. No vendor shall operate in the <br />city except between the hours of 7:00 A.M. and 10:00 P.M- Hours <br />of operation may be extended with the prior written permission of <br />the City Manager, All stands. except those approved by City <br />Council pursuant to Section 25-28.1 as part of an outdoor cafe <br />must be removed from public 2roperty during non-operating hours, <br />fc) Signs. No sians shall be permitted on or with any <br />vendor stand. except a price sign and a sign or logo identifyiag_ <br />the name of the vendor or the product beina sold. provided th&L <br />neither sign shall be greater than two sauare feet in area, <br />(d) Vendina machines.
