• AN ORDINANCE <br />TO AMEND AND REORDAIN SECTION 16-43.2 OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, <br />REQUIRING ABOVE -GRADE SIGNS IN PARKING SPACES <br />DESIGNATED FOR THE HANDICAPPED. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that Section 16-43.2 of Article III of Chapter 16 of the <br />Code of the City of Charlottesville, 1976, as amended, is hereby <br />amended and reordained as follows: <br />Section 16-43.2. Parking in spaces reserved for the <br />handicapped. <br />(a) The City manager and traffic engineer may designate spaces <br />on streets and other public parking lots of the city and the owners <br />or persons in control of parking areas of privately owned shopping <br />centers and business offices open to the public may designate <br />spaces in such areas, to be reserved for the exclusive use of <br />handicapped drivers. Such designated spaces shall be identified <br />by above -grade signs. It shall be unlawful for any person to park <br />a motor vehicle in any space so designated, who has not been issued <br />a special decal or license plates or parking permit by the <br />commissioner of motor vehicles pursuant to section <br />• <br />46.2-731, 46.2-739 or 46.2-1238 of the <br />Code of Virginia, 1950, as amended, and whose vehicle is not <br />displaying such special permits, plates or decals. <br />(b) Persons who have been issued such special permits, plates <br />or decals by the commissioner of motor vehicles shall be permitted <br />to park their vehicles displaying such permits, plates or decals <br />in disregard of the provisions of sections 16-35 and 16-45(a) of <br />this article, but shall comply with all other provisions of this <br />article in the same manner as any other persons are required to <br />comply therewith. <br />(c) Any police officer or other designated uniformed <br />personnel, whether employed on a paid or voluntary basis by the <br />City, may issue a summons to the nonhandicapped operator of a motor <br />vehicle parked in parking spaces reserved for the handicapped on <br />public property, or at privately owned shopping centers and <br />business offices without the necessity of a warrant's being <br />obtained by the owner or other person in control of such property. <br />Approved by Council <br />October 2, 1989 <br />•rk of Council <br />89-7-35 <br />
