• AN ORDINANCE <br />TO AMEND AND REORDAIN SECTION 12-6.1 OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, <br />RELATING TO GAS TRANSPORTATION SERVICE. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia, that Sections 12-6.1 of Chapter 12 of the Code of the <br />City of Charlottesville, 1976, as amended, is hereby amended and <br />reordained as follows: <br />Section 12-6.1. Interruptible Transportation Service. <br />(i) Customer Providing More Gas Than Customer's Usage. In <br />any month when either type of transportation customer's actual gas <br />usage at any metered service connection is less than the <br />transportation gas available for that metered service connection, <br />the City will provide load balancing on a seasonal basis with the <br />same tolerance limits for overtenders as Columbia Gas provides the <br />City. As of June 1, 1989, such tolerance limits and penalties <br />imposed by Columbia Gas were as follows: <br />(1) During the period from November 1 through Aprr+-39 <br />• March 31, transportation gas available for any month may <br />exceed actual gas usage for that month by 3% or less of <br />scheduled transportation gas for that month without <br />penalty. <br />(2) During the period from May April 1 through <br />October 39 31, transportation gas available for any month <br />may exceed actual gas usage for that month by l0% or less <br />of scheduled transportation gas for that month without <br />penalty. <br />Transportation gas available for a metered service connection is <br />the transportation gas delivered to the City, reduced by the City's <br />shrinkage rate, plus any imbalance allowed from the previous month. <br />When the imbalance for any metered service connection exceeds these <br />limits, the City shall retain the excess tenders, and the customer <br />shall pay a penalty equal to that penalty charged the City by <br />Columbia Gas or others as a result of such excess imbalance. <br />Approved by Council <br />September 18, 1989 <br />• erk of Council <br />89-7-32 <br />
