• (3) The customer warrants that it has good and legal <br />title to all gas supplied to the City, and agrees to indemnify and <br />hold the City harmless from any loss, claims or damages in regard <br />to such title. <br />• <br />(4) The customer provides the City with all <br />documentation deemed necessary by the City to show that requisite <br />approvals for acquisition and use of customer -owned gas have been <br />secured from all regulatory bodies having jurisdiction. The <br />customer is responsible for making any filings or reports, as <br />required, pertaining to the acquisition and use of the gas and the <br />transportation of the gas from the customer's source to the City's <br />interconnection with the delivering pipeline supplier. <br />Customer's failure to comply with federal and state statutes or <br />regulations as they apply to Customer's use of TS gas <br />(5) The customer will provide or cause its gas supply <br />source or pipeline transporter agrees to provide on a timely basis <br />no later than the tenth twenty-fifth calendar day of each month, <br />daily transportation data for such gas delivered to the City during <br />the preceding calendar month, including volumes and cost to <br />me*mm�r of oll r.a AolivnreA +., ni*v ... ....,.}---- I- _-� -� <br />(6) The capacity of the City's facilities and other <br />conditions are sufficient to deliver the quantities requested by <br />the customer. <br />lose its "grandfathered" status for transportation purposes and <br />shall not be eligible to receive TS gas in the future unless it <br />meets all terms of this ordinance applicable to TS customers <br />• agreement. <br />61 <br />
