• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF AN ALLEY OFF UNIVERSITY AVENUE. <br />WHEREAS, proper notice that Piedmont Virginia Property Group <br />would request the City Planning Commission to initiate street <br />closing procedures to close a portion of the alley located off <br />University Avenue and running parallel to 13th and 14th Streets, <br />N.W., was duly posted and advertised; <br />WHEREAS, owners along the street proposed to be vacated have <br />been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and <br />City Council was held on September 11, 1990, and comments from the <br />City staff, the Planning Commission and the public were made and <br />heard; and <br />WHEREAS, the Planning Commission recommended closure of the <br />alley off University Avenue, running along the west side of the <br />University Theater; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that said alley, described as follows, is hereby closed, <br />• vacated and discontinued as a public thoroughfare of the City of <br />Charlottesville, Virginia, said alley not being needed for public <br />use and travel: <br />That portion of a 12 foot wide alley located <br />off University Avenue, from its intersection <br />with University Avenue and terminating <br />approximately 144 feet in a northerly <br />direction, such portion being adjacent to <br />Parcels 7 and 8 and a small portion of Parcel <br />1 on City Tax Map 10, all as more particularly <br />shown on the attached sketch. <br />PROVIDED, that this closing is subject to the following <br />conditions: <br />(a) Applicant will show on its site plan a pedestrian <br />access easement at least 12' in width allowing access by members of <br />the public to University Avenue from the westernmost property line <br />of Applicant's property, said easement to be maintained by <br />applicant or its successors in title; <br />(b) Improvements in that portion of the alley being closed <br />will be subject to administrative design review for compatibility <br />• with properties in the surrounding area as part of the site plan <br />review process; and <br />
