Approved by Council April 16, 199C <br />AN ORDINANCE <br />• AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED <br />IN SECTION 31-4 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, BY THE REZONING OF PROPERTY <br />LOCATED AT 1329 CHESAPEAKE STREET <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the District Map Incorporated in Section 31-4 of the <br />Zoning Ordinance of the Code of the City of Charlottesville, 1976, <br />as amended, be amended and reenacted as follows: <br />Section 31-4. Zoning District Map. <br />Rezoning from R-2 Residential to R-2 Residential Planned Unit <br />Development (PUD) the property located at 1329 Chesapeake Street. <br />This property is further identified on City Real Property Tax Map <br />#55 as Parcels 66 and 74, having approximately 150 feet of frontage <br />on Chesapeake Street, and containing, collectively, 141,570 square <br />feet of land or 3.25 acres. <br />The rezoning of the above -referenced property is conditioned <br />upon the following: <br />1. Administrative approval of the final revised site plan with <br />• the following conditions: <br />a) Upgrading of the drainage system to accomodate the run- <br />off from this development, as may be needed; <br />b) That the sidewalks can be modified to route around and <br />away from the large Linden Trees on the west side of the access <br />road; <br />c) That the setbacks/building envelopes be further modified <br />on Lots 3 & 4 to help with siting the houses to avoid damaging the <br />Lindens on these sites. <br />2. a) Reasonable attempts must be made to preserve, replenish, <br />protect, and utilize existing trees on the project site. To that <br />end, prior to the start of work on the site, the applicant shall <br />prepare a proposed tree protection and replacement plan and then <br />obtain administrative approval of such plan from the Department of <br />Planning in consultation with the City Arborist. <br />b) All trees over 8" in caliper which are removed prior to <br />or during construction of the project shall be replaced on a one <br />to one basis. During the 36 month period following completion of <br />construction, the developer shall, on the same one to one basis, <br />replace any tree of 8" caliper or larger which has died, been <br />destroyed, or irreparably harmed as a result of construction. For <br />purposes of this condition, "one to one basis" shall mean that the <br />• sum of the replacement tree calipers of the new trees being planted <br />shall equal seventy-five (75) percent of the sum of the calipers <br />
