Approved by Council April 16, 199C AN ORDINANCE • AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, BY THE REZONING OF PROPERTY LOCATED AT 1329 CHESAPEAKE STREET BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the District Map Incorporated in Section 31-4 of the Zoning Ordinance of the Code of the City of Charlottesville, 1976, as amended, be amended and reenacted as follows: Section 31-4. Zoning District Map. Rezoning from R-2 Residential to R-2 Residential Planned Unit Development (PUD) the property located at 1329 Chesapeake Street. This property is further identified on City Real Property Tax Map #55 as Parcels 66 and 74, having approximately 150 feet of frontage on Chesapeake Street, and containing, collectively, 141,570 square feet of land or 3.25 acres. The rezoning of the above -referenced property is conditioned upon the following: 1. Administrative approval of the final revised site plan with • the following conditions: a) Upgrading of the drainage system to accomodate the run- off from this development, as may be needed; b) That the sidewalks can be modified to route around and away from the large Linden Trees on the west side of the access road; c) That the setbacks/building envelopes be further modified on Lots 3 & 4 to help with siting the houses to avoid damaging the Lindens on these sites. 2. a) Reasonable attempts must be made to preserve, replenish, protect, and utilize existing trees on the project site. To that end, prior to the start of work on the site, the applicant shall prepare a proposed tree protection and replacement plan and then obtain administrative approval of such plan from the Department of Planning in consultation with the City Arborist. b) All trees over 8" in caliper which are removed prior to or during construction of the project shall be replaced on a one to one basis. During the 36 month period following completion of construction, the developer shall, on the same one to one basis, replace any tree of 8" caliper or larger which has died, been destroyed, or irreparably harmed as a result of construction. For purposes of this condition, "one to one basis" shall mean that the • sum of the replacement tree calipers of the new trees being planted shall equal seventy-five (75) percent of the sum of the calipers
