of the tree or trees being replaced ( "tree or trees lost") . At <br />• least one of the replacement species for each tree lost shall be <br />of the same kind as the tree lost and all others counting toward <br />replacement of that particular tree lost shall be indigenous shade <br />trees. <br />c) Assurances that the above requirements will be followed, <br />shall be secured through an appropriate bond, certificate of <br />deposit, or similar vehicle placed with the City, the details of <br />which shall first be approved by the City Attorney. The period of <br />such assurance shall be limited to five (5) years from the date the <br />tree plan is approved. Tree replacement which occurs prior to and <br />during construction and up to that point where at least 66.6 <br />percent of the homes in the project are sold shall be the <br />responsibility of the applicant/developer. <br />d) Trees of 8" caliper or larger which, through no fault of <br />applicant/developer, are found prior to the start of any work on <br />the project site to be "dead, irreparably harmed, or potentially <br />hazardous to the public or to persons occupying the site" shall be <br />exempted from the replacement requirements of this ordinance. <br />Eligibility for this exemption shall be determined by the <br />Department of Planning and Community Development in consultation <br />with the City Arborist. <br />3. All utilities on site shall be placed underground. <br />• 4. Additional split rail fencing shall be provided along the <br />entire common property boundary at Meade Park in order to <br />protect City property. Opaque privacy fencing shall be <br />provided along the Northeast property boundary and along the <br />rear property lines of neighboring lots fronting on <br />Chesapeake Street. <br />A soil erosion/sediment control plan shall be approved <br />administratively before final site plan approval. <br />6. A subdivision plat shall be submitted for review and approval <br />prior to final site plan approval. All lots shall front on <br />a public street or front on an access easement providing <br />sufficient access to a public street. <br />7. All homeowners' association documents shall be approved by the <br />City Attorney prior to final approval of the site plan. The <br />homeowners' association documents shall include description <br />of common land facilities and amenities required to be <br />maintained by the homeowners' association, including the <br />protection and maintenance of trees. <br />8. Developers shall pay for fencing, up to a maximum of six <br />thousand dollars ($6,000), to be installed along the Meade <br />Avenue side of Meade Park. <br />• Approved by Council atL4 .�ne� CK <br />April 16, 1990 C rk of City Council <br />90-7-11 <br />
