1AN ORDINANCE <br />TO AMEND AND REORDAIN SECTIONS 26-26 AND 26-31, AND <br />TO ADD A NEW ARTICLE TO CHAPTER 26, OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />RELATED TO IMPOSITION OF USER FEES <br />FOR COMMERCIAL REFUSE COLLECTION. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia, that: <br />1. Sections 26-26 and 26-31 are hereby amended and <br />reordained, and a new article, Article III, entitled "User Fees For <br />Commercial Refuse Containers" is hereby added to Chapter 26 of the <br />Code of the City of Charlottesville, 1990, as amended, to read as <br />follows: <br />ARTICLE II. COLLECTION BY CITY <br />Section 26-26. Violations of artie}e chapter. <br />Unless otherwise specifically provided, a violation of any <br />provision of this artieie chapter shall constitute a Class 1 <br />misdemeanor. <br />Section 26-27. General container requirements. <br />All ashes, glass, kitchen garbage consisting in whole or in <br />part of foodstuff, tin cans and other damp garbage shall be drained <br />and placed in a closed nonleaking container of not over thirty (30) <br />gallons capacity. <br />Section 26-28. Paper, cartons, etc., to be placed in <br />containers or bundled. <br />(a) Dry trash, such as paper, old cartons, weeds, brush or <br />brush trimmings not exceeding three feet in length may be placed in <br />the container required by section 26-27 or may be placed in baskets <br />or boxes, if the material is secured so as to prevent the trash <br />from being blown therefrom. Newspapers and magazines not in a <br />container shall be bundled and tied. <br />Section 26-29. Preparation of leaves for collection. <br />(a) During the months of October through January, it shall be <br />unlawful to place leaves in containers for collection by the City. <br />During such months, leaves shall be placed at the curb or street <br />edge for vacuum collection. It shall be unlawful to rake leaves <br />into any street far enough from the curb or street edge so as to <br />create a traffic hazard. The safe distance from a curb or street <br />edge for the deposit of leaves for vacuum collection will vary <br />' depending on street widths and other traffic conditions. It shall <br />be unlawful to rake leaves onto a sidewalk so as to cover its <br />entire width and obstruct pedestrian traffic on such sidewalk. <br />
