E. The representatives shall prepare and submit to <br />the City and Grantee a written report of its findings and <br />• any appropriate recommendation. <br />F. Upon request of the City, Grantee shall report <br />to the City, at a regular or specially scheduled meeting <br />of the City, its findings as to the status of the System, <br />and whether it agrees with the findings of the <br />representatives. Should Grantee agree that corrective <br />action is required, it will report as to the status nf <br />corrective measures planned and undertaken currently. <br />Should the representatives find that Grantee has operated <br />the System properly and no legitimate basis for the <br />complaints exists within the control of Grantee, then the <br />City shall pass a Resolution stating that it has <br />investigated the matter and that the Grantee is absolved <br />from any wrongdoing in that matter. Nothing herein shall <br />prevent Grantee from providing City with such additional <br />evidence or information as Grantee deems relevant. <br />8.07 Periodic Evaluation and Renegotiation Sessions. The <br />field of cable communications is a relatively new and rapidly <br />changing one which may see many regulatory, technical, <br />financial, marketing and legal changes during the term of this <br />Franchise. Therefore, in order to provide for a maximum degree <br />of communication between the parties, and to help achieve a <br />continued advanced and modern System, the following evaluation <br />provisions will apply: <br />• A. The City and Grantee shall hold anm_int <br />evaluation sessions during the term of this Franchise. <br />B. Topics which may be discussed at any evaluati%�n <br />and session include, but are not limited to, Channel <br />capacity, the System performance, programming, access, <br />municipal uses of cable, Subscriber Complaints, customer <br />service, telephone answering performance, judicial <br />rulings, FCC rulings and any other topics the City or <br />Grantee deem relevant. <br />C. During an evaluation session, Grantee shall <br />fully cooperate with the City and shall provide without <br />unreasonable cost such information and documents, <br />including, but not limited to, telephone response <br />information, as the City may request. <br />D. As a result of an Evaluation an,I <br />Renegotiation Session, the City -1. grantee in•+•: <br />determine that a change in the terms -f the Franchi.-:- <br />may be required, that the System or Franchise <br />requirements should be updated, changed or th.al <br />additional services should be provided.
