E. The representatives shall prepare and submit to the City and Grantee a written report of its findings and • any appropriate recommendation. F. Upon request of the City, Grantee shall report to the City, at a regular or specially scheduled meeting of the City, its findings as to the status of the System, and whether it agrees with the findings of the representatives. Should Grantee agree that corrective action is required, it will report as to the status nf corrective measures planned and undertaken currently. Should the representatives find that Grantee has operated the System properly and no legitimate basis for the complaints exists within the control of Grantee, then the City shall pass a Resolution stating that it has investigated the matter and that the Grantee is absolved from any wrongdoing in that matter. Nothing herein shall prevent Grantee from providing City with such additional evidence or information as Grantee deems relevant. 8.07 Periodic Evaluation and Renegotiation Sessions. The field of cable communications is a relatively new and rapidly changing one which may see many regulatory, technical, financial, marketing and legal changes during the term of this Franchise. Therefore, in order to provide for a maximum degree of communication between the parties, and to help achieve a continued advanced and modern System, the following evaluation provisions will apply: • A. The City and Grantee shall hold anm_int evaluation sessions during the term of this Franchise. B. Topics which may be discussed at any evaluati%�n and session include, but are not limited to, Channel capacity, the System performance, programming, access, municipal uses of cable, Subscriber Complaints, customer service, telephone answering performance, judicial rulings, FCC rulings and any other topics the City or Grantee deem relevant. C. During an evaluation session, Grantee shall fully cooperate with the City and shall provide without unreasonable cost such information and documents, including, but not limited to, telephone response information, as the City may request. D. As a result of an Evaluation an,I Renegotiation Session, the City -1. grantee in•+•: determine that a change in the terms -f the Franchi.-:- may be required, that the System or Franchise requirements should be updated, changed or th.al additional services should be provided.
