Prepared November 10, 1992 <br />• AN ORDINANCE <br />AMENDING AND REORDAINING SECTIONS 22-18, 22-19, <br />22-73, AND 22-74 OF CHAPTER 22 OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />RELATED TO THE REQUIREMENT FOR PERFORMANCE BONDS <br />BY CONTRACTORS DOING WORK FOR THE CITY. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia, that: <br />1. Sections 22-18 and 22-19 of Article I, and Sections 22-73 <br />and 22-74 of Article II, of Chapter 22 of the Charlottesville City <br />Code, 1990, as amended, are hereby amended and reordained as <br />follows: <br />ARTICLE I. In General. <br />Sec. 22-18. Performance and payment bonds generally - <br />Nonconstruction contracts. <br />(a) For contracts other than construction contracts, valued <br />over one hundred thousand dollars <br />($100.000.001, successful bidders shall be required to furnish a <br />. performance bond in the amount of one hundred (100) percent of the <br />amount bid and, if applicable, a payment bond in the same amount, <br />unless such bonds are waived in the invitation to bid or request <br />for proposal. <br />(b) In the discretion of the purchasing agent, successful <br />bidders on nonconstruction contracts of ten- theesaftd- dol -.-errs <br />t$ -18;888-80i one hundred thousand dollars (5100,000.00) or less may <br />be required to furnish performance and payment bonds, provided Lit <br />if notice of the requirement is included in the invitation to bid <br />or request for proposals. and (ii) if the City's experience and the <br />performance and payment bonds. <br />Sec. 22-19. Same - Construction contracts. <br />(a) Upon the award of any construction contract exceeding ten <br />tkensend--de33es--{�iflOE�flE)-1 one hundred thousand dollars <br />($100.000.001 to any contractor, such contractor shall furnish to <br />the city, in a form acceptable to the city attorney, the following <br />bonds: <br />(1) A performance bond in the sum of the contract amount, <br />conditioned upon the faithful performance of the contract <br />in strict conformity with the plans, specifications and <br />• conditions of the contract. <br />(2) A payment bond in the sum of the contract amount.
