If similar obligations imposed by this Franchise <br />are not imposed or enforced with respect to any other <br />franchised cable television operator, including a <br />municipally -owned cable system serving any portion of the <br />Franchise area, this Franchise shall be immediately <br />amended in writing to relieve Grantee of such obligations. <br />C. In the event a court of competent jurisdiction <br />issues a binding and final court order declaring that the <br />City has: 1) unlawfully discriminated or otherwise <br />discriminated against Grantee by failing to enforce, upon <br />any other satellite master antenna television system, <br />multipoint multichannel video distribution system, or a <br />municipally -owned cable system, all lawful taxes, fees and <br />assessments, or 2) unlawfully enforced against Grantee any <br />tax, fee, or assessment. Grantee shall, after affording <br />city a minimum of sixty (60) days within which to cure any <br />discriminatory behavior, be relieved of such taxes, fees, <br />and assessments, as the court may determine and for the <br />court ordered period of time, until such time as the City <br />corrects such discriminatory behavior. <br />4.11 Compliance with Laws, This Franchise is granted as <br />an exercise of the City's governmental powers, pursuant to the <br />specific authority conferred upon it by Section 15.1-23.1 of <br />the Code of Virginia, as amended. <br />40 4.12 CATV CItizenAdvisory ommi <br />A. After acceptance by the Grantee of this <br />Franchise, the City Council may appoint five (5) residents <br />of the City and one additional City representative (either <br />from the City Council or City staff) to the CATV Citizen <br />Advisory Committee. Grantee shall also appoint one (1) <br />member to the CATV Citizen Advisory Commission. The City <br />Council may designate a chairperson of the Committee and <br />members of the Committee shall represent a cross-section <br />of the City's residents, Appointed members of the City <br />shall serve for a term of three (3) years. Members may <br />serve consecutive terms subject to confirmation by the <br />City Council. <br />B. The CATV Citizen Advisory Committee shall meet <br />at the call of the chairperson- or at such other times as <br />the Committee shall determine. <br />C. The CATV Citizen Advisory Committee shall: <br />1. Make suggestions to the City Council, from <br />time to time, on how administration and enforcement <br />of this Franchise may be improved; <br />• 2. Upon request from the City Council, advise <br />the City Council on the regulation of rates in <br />accordance with local, state and federal law; <br />
